Hello VJers! The time has come for me to submit my Affidavit of Support (I-864) and I am working on it this weekend. In Question 21 (Household Size) it is not at all clear where I list my wife in this section. Is it better to list her in 21A (Persons you are sponsoring in this affidavit) or in 21C (Spouse)? I understand that I am not supposed to list her twice, but the directions do not stipulate which is the preferred option. Above question 21C it does say "Persons NOT Sponsored in this Affidavit" so I assume it is most correct to list her in 21A. I am sure this has been discussed on here before, but I could not find a thread when I tried to search for it. I appreciate any of your opinions on this. Thanks.

I had the same question. But I think she would be a part of the immigrants you are sponsoring section. That's what we ended up doing. I hope someone else can clarify.

Have you looked at the Example Forms? I was trying to look to help you out, but didn't see a question 21, so I was a bit confused. I haven't gotten to this point myself. From what you are saying, it sounds like she definitely can't be listed under 21C, so it must be under A. Unless someone else knows something better and can explain smile.gif

But that doesn't make any sense to me... did you look at the form Andrea? I just looked at it online, and 21a is for "Persons you are sponsoring on this affidavit" and 21b - 21g are prefaced by "Persons NOT sponsored on this affidavit." (the capital letters are theirs not mine smile.gif

You obviously have to put something in 21a (because it says write in the number you put on line 10) - and the number on line 10 is the total number of immigrants you are sponsoring. You have to put 1 in 21a (unless you are sponsoring more than one, which I'm assuming you are not) - and then if you put in anything in 21c, you would be counting your wife twice.

So I have now absolutely convinced myself that the answer is 21a. smile.gif Now I shall return to studying, I just can't stop checking the forums!

Hey Mark, are you filing the I-864 or the EZ form. The EZ form has the wife listed under wife, as an automatic entry. You have no choice as to where to put her. Given this I would list Sofia under "wife" and not the immigrant. I am assuming this is for kids if they are being sponsered.

You would check box 21a for the person you are sponsoring. Box 21c is if you had a spouse here and you were sponsering a family member. As usual the government wasnt thinking to clearly when they thought up these questions because for us who are married would think to check the box for our spouse because thats what they are.

That was my knee-jerk as well when I read the post , then quickly scanned the instructions..put spouse where it says spouse for frig sake. Then of course riblet showed me the error of my thinking( she's good for that that dang smart lawyer to be that she is). After looking over my own I864 I saw that I had in fact put my husband in the 21a box and left 21c blank. whistling.gif

List her on 21A and leave 21C blank. But you may wanna write a note by 21C that she has been counted on 21A, therefore, you are leaving 21C blank.
