Full Version: I 864 petioners form????

we are doing a K3 Visa. I have submitted by fax my check list and I am waiting to be appointed
an appt. date.
My husband has not received the I 864 form as of yet! How does this work? anyone
know? my question is...does it has to be submitted prior to interview? at interview?
or has to be submitted at time of AOS? I find reading the downloaded form and
instruction online to be a little confusing?

The Affidavit of Support for K3's is the I134 not the I864 if I recall correctly. I'm not sure when it gets submitted - at the interview I think. I'm sure someone else will help you out smile.gif

well I thought it was an I 134 also...but the letter my husband received mentioned
I 864 ...
when I go online to check out the form down load...it says the I 864 form has an
expirey date being the Sept 2006. I am not sure if they are still referring to the
form???

thats another confusing thing!

The September date refers to an OMB expiration, which is some sort of review of forms, it doesn't have anything to do with people using forms - it used to really confuse me smile.gif

The K3 Visa involves first the I-130 CR/IR-1 Immigrant Visa petition that requires the I-864. That is a seperate and paralell process to the K-3 Visa.

Its possible your I-130 CR/IR-1 Visa petition has been approved and is being processed at the NVC.

In this case, your not talking K3 anymore.

That's true, I was thinking it was strange that her husband received a letter. Actually, I just looked at your timeline cdancer, and you've been approved for both petitions. Did you realize that both processes are still going on? Have you received the choice of agent form from the NVC?

OH Man... LOL now I am really confused!!!!

I know that I 130 & 129 F were both approved on the same day!

then we both received our "choice of agent forms" (which is ourselves and sent them both
off to the address requested)

my husband received a letter stating I would be sent my packet 3 from the Vancouver Consulate,
which I received this past Monday and have now faxed back the check list and now waiting
for interview date confirmation.

My husband had to send a $70 fee for the "affidavit of suport "...it was noted...once the
fee is received they will send the I864 forms with further instructions! At this time he
has not received the forms!

OK so whats your take on this????? Riblet & cmartyn???

The packet 3 from Vancouver would be for your K3.

The Choice of Agent & I864 are for the CR/IR1.

So basically it makes sense to interview for the K3, then you have a choice. Do you want to continue to pursue the I130 and go to Montreal in about 4 - 6 months for an interview for green card. OR just adjust status in the U.S. and stop pursuing the I130.

If your husband has submitted the Affidavit of Support fee to the NVC, then he can call to see if they have sent out the I864.

And if you do go to the U.S. on the K3, you won't be able to work for about 3 months until you get your EAD.

I hope I'm not being too confusing - I'm not sure how much you know about the 2 processes smile.gif Feel free to ask for clarification if you need it!

I guess I have to educate myself on the CR/IR1

The way I saw it...was to get my K3,
finally get into the country to live with hubby
apply for an EAD , then get a SS #
have the ability to have multiple entry/in and out of the USA
until I AOS

My plan is to be moved to the US legally by the end of March.

not really interested in travelling from Vancouver to Montreal
this whole thing is costly enough...LOL!

I hope I am going about this the correct way!

any suggestions

If you definitely just want to purse the K3, don't pay anything more to the NVC smile.gif The IR/CR1 interviews are only done in Montreal. As you are going through Vancouver, it seems likely that you would be done much faster on the K3.

I have a feeling that if you pay the $380 immigration bill to the NVC, they may not apply that towards your AOS. I really don't know though, but I believe at this point you can notify the NVC that you plan on Adjusting status, and don't want to continue processing with them.
