Afternoon all
I would really like to find something out if possible. I have intentions of going to see my Fiance' Lorry in WA U.S.A.
I want to go spend some of the Christmas Holidays with her from Dec 26 to Jan 3 Our K-1 was filed in Sept and is in process
At POE will they allow me to go and spend this time with her. Or will they tell me no I have to remain here in Canada
I have already purchased my flight ticket Hope I can get to use em
Any info on this matter would be greatly appreciated

Only a CBP officer can tell you yes or no. Do your best to prove to CBP that you will return home on Jan 3rd. All you can do is take proof of ties to home (return ticket, bank accounts, employer statement, a mortgage or rental agreement, etc etc) with you, and take your chances.

I was denied trying to go to the US. I had an I 130 pending at the time. The problem is that we are not Tourists anymore, we are intended Immigrants. They took my digital prints, and I am now red flagged in the system. But Delta will still honor my airline ticket for 1 year, minus a $50 fee for changing dates.

it all depends on the CBP officer...
a lot of people have no problems visiting the US ... you just need to bring along some proof that you plan to return to Canada and be as honest as possible without giving anymore info then they ask for but it still isn't a given that they will let you in....
and Wilhelmina from your time line it sounds like you might have been living in the US already, maybe that is why they denied you... you didn't have enough ties to Canada....

Do a search and one wil see this question comes up weekly!. Some have probelems , some do not. All depends on the POE officer. I travelled monthly to the DC and never had a problem or hiccup,while others do get denied. All depends if the POE officer thinks your going to stay or not. Maybe some of the people that get denied get rude, appeared nervous, have lots of luggage that appears suspicious, who knows. I traveleld monthly and not a problem, thats just my experience. No one can give you a 100% yes or no answer, one sort of takes their chances. I guess there are things to increase your chances,ie ties to canada (letter from employer, lease papers, ie) dont travel with lots of luggage, answer question politely, look into his eyes. Best of luck

Yes, definitely take proof of ties to Canada. I had gone to visit my fiance for the Thanksgiving holidays. We were planning to have him come back with me to visit. He was refused entry because it looked like he did not have ties to Canada. If we had known how to prove ties, we definitely would have brought documentation, but at the time, we were really caught off guard and soooooo unprepared.

One other question what other items could I provide to show proof of my ties to Canada and that I do intend on returning home on Jan 3
Also what is the employer letter Is it a verification that I'm employed here in Canada

Just a letter from ur employer stating you work for them and are expected back on such a date for work. Ties include lease agreement, bills, return airfare, thats not a big one as most know its cheaper to buy tickets that way.

Wilhelmina, were you denied in Edmonton? If so, what was the officer's name? I was denied there, and am considering filing a complaint so maybe the same thing won't happen to others.

Other people have also taken their K1 paperwork along to show that they are in the process of doing it legally and have no intention of thwarting the system.

I just took the chance today. We bought my airplane tickets for December 24th as its the only way to see each other.
Im waiting for my packet 4, so Ill bring the packet 3 letter , my medical bill, police certificate, etc to show how deep we are in the process, and got letter from my employer, car lease and of course return ticket even if its not that big of a deal.
Its gonna be the first time that I try. But for me its worthed to waste that money to have the chance to spend the holidays with my fiance and his family (they keep asking why i cant be there). The worst thing that can happen is that my holidays are gonna look like they should have in the first place if I'm denied...
My POE is gonna be Montreal airport.

I'm taking that chance too I have my flight tickets bought for sometime now
I'll be leaving Nova Scotia on the 26 th for Washington State
I don't have any of the USCIS paperwork to bring but will have my Mortgage
agreement an Employer letter, some bill statements, Bank statements and return ticket
I hope that will be enough to show ties to Canada still

Besides, everytime I did vist him in the past before we sent the K-1 I was always saying to the officer that Im visiting my friend and his family. They were asking me if it was a man, if I work in Canada and thats about it. Never had problems.
So I really doubt they have added the K-1 information based on my passeport number since I just sent it back to Mtl embassy. And I doubt that customs and immigration contact each other for every case submitted. So if they scan my passeport and say nothing about a K-1, ill just stick to my "very light information" story. As everybody say saying too much is not better sometimes.
IF they do ask me if I have a relationship and if i intend to live there, Ill say everything, yes and yes upon the receiving of my visa. Just be true.

That is what I was thinking too How will they know we have a K-1 Visa

Would they have me in thier search system already with just the application
on going since Sept.
I have never had problems before going through Customs the usual questions
and stern faces never a smile on my 2 previous trips, not yet anyhow lol lol
I suppose that is true not to volunteer more than they ask
The main thing is being truthful with them rather than risk being
not let in.

I bought a ticket for Dec 27-Jan 1 for the upcoming holidays...even though he is coming to Ottawa from Dec 17-27, I just didn't want to say goodbye yet cause he'll be deployed for 6 months....so Merry xmas to him, I haven't told him yet!!! Hopefully he'll like the surprise and hopefully the POE wont give me a hard time. So far so good... I've travelled to the USA 6 times in the last 6 months, never had a problem. Always, always, carry proof of ties to Canada and answer truthfully to their questions and you should be good to go! Oh yes, and I always have my K1 paperwork with me as well.
