Full Version: How does having a baby by another woman affect chances of k3?

A friend of mine just got married to her foreign husband. He, however, has a newborn baby by another woman, a relationship that was ending when she got pregnant. We actually think that it was a last ditch effort to get him to stay with her... It didnt really work.
So now my friend and her new husband want to start the k3 process. How will the newborn baby be looked at in the visa process? Does it make them look suspicious?

Sarah Rose Allen,

It makes him look virile.

[EDIT: I should add, will the baby be applying for a visa along with it's father? Either way, this child will be looked at the same way any child of a visa applicatnt is looked at.]

I imagine that it wouldn't be too much of a problem, as long as the USCIS doesn't have any other reason to doubt the validity of their relationship. That's the only way I could see it affecting the petition.

It depends. Was the other woman his sister? laughing.gif

Thanks for all of the light hearted replies... Im interpreting that to mean that you all dont think that this is a red flag issue.
If anyone has any real or serious comments or experience it will be welcomed.

Sarah Rose Allen,

Unless the suppositions have been confirmed by the other woman it's your friend who should be seeing a 'red flag'.

Why should it be a problem? Is he bringing the baby with him to the US? Will his ex cause problems during the process? Will he be applying later for the child to follow? Will he have a problem leaving his child behind or does he even care?

Having a child by someone other than the person you are currently married to is not in and of itself a red flag for immigration. There are likely hudreds if not thousands of people who have children of prior relationships successfully complete this process every day. They call them "step-children".

It is not USCIS's job to judge past relationships, only the current one.
