Hey all .. this is probably going to be a silly Q .. my wife is the one who usually posts here .. but here goes, When we apply for her AOS .... do we need to also apply for EAD and AP .. or once she gets her AOS approved she can work and travel with her Temp green card ?

You do not have to apply for EAD or AP. They are both optional.

Once she gets the permanent residence card, neither is needed.

(That said, be aware that you could potentially be in for a very long wait for your AOS. EAD and AP are like insurance -- optional, but if you're waiting a long time, you may wish you had them!)

The answer to your question is right there in the guides.

See where it says I-765 (EAD), and I-131 (AP), (Optional)

You may want to get your fiance the SS card shortly after arriving in the states, no cost there.

Be aware that AOS can be short or very long to complete, so if your fiance would like to work, applying for EAD is a small expense and is worth it.

We opted for just AOS and we were approved and received the green card in about 6 months. You can save the money for EAD and AP if you are willing to wait - also if the interview doesn't get scheduled soon enough - you can apply for the EAD or AP whichever you want. In my wife's case - she is still learning English and is only now ready to work - so it didn't make any sense to pay for the EAD early on. Good Luck

its optional. but who the hell knows about the waiting time. some took years before they got their green card approved, some got lucky and only had months, just like me biggrin.gif. If I just knew that I was gonna get my EAD approved almost the same time as my AOS, I would have not applied for it... cuz its a freaking $180

One other thing to consider, if your spouse wants a drivers licenses, most states require SS number, and either Green Card, or EAD before they will issue a drivers license.
