Full Version: I-130 APPROVED

I found out today that our I-130 was approved on the 18th!!! Our I-129F is still pending at the same office (VSC) so my question is this.... what now? What is the next (and fastest) step towards getting my baby back into the country so we can properly start our lives? Do we still have to wait for the K-3 to get her back or what. Thanks in advance.

A few things to consider, if you stay with the K-3 which lately is still a bit faster, you still will have to deal with the time waiting for Adjustment of Status in the states. If you wait the extra time invilved with the CR-1 visa, you will be doing the visa interview and green-card interview at same time and wont have to do AOS in the states.

One other thing the aproval of the I-130 just means it is moving on to NVC were several things need to be done before it moves to the consulate. The I-129F usually reaches the consulate before the I-130 petition.

So now the case is transferred to the NVC and then its sent to the consulate? If we stick with the I-130 path does that mean that she can come to the US after her interview etc or do we have to file her adjustment paperwork and wait for that before she can come back? Bottom line is... we dont care how long it takes for her to get her status adjusted and her green card issued... we just want her back in the States with me while we wait. That said... what is the fastest option for us to take?

If your main concern is speed, you can continue to pursue both petitions and see what happens.

When the I130 gets to the consulate, it overrides the K3 so the decision would basically be made for you if they are both at the consulate at the same time.

If your wife has an interview and is granted an IR/CR-1 visa, she will enter the U.S. as a permanent resident and will not have to adjust status. She will be able to come as soon as the visa is issued (generally within a day or so of the interview if approved.)

I still don't fully understand how the K-3 is fastest now that our I-130 has been approved. If our I-130 is off to the NVC and there's no telling when the I-129F will be approved how could the K-3 be the way to go?

Is it abnormal for the I-130 to be approved before the I-129F? I was surprised that it was approved first because the K-3 was supposed to be put into existance as an alternative to the long waits that came with I-130. Am I mising something?

K3 is NOT always the fastest - it was designed to be the fastest, but it doesn't always work out.

It is still possible though that the K3 will be completed first. The K3 was supposed to bring couples together faster, unfortunately it doesn't seem to be working very well sad.gif

I'm sure more people will tell you that if you can afford it, the best option is to continue with both petitions and see which one will be approved first. The I130 stays at the NVC for a much longer time than the K3, so that is why it is possible that the K3 could beat it to the embassy.

In my case my I-130 was approved 15 days before my I-129F (K-3).

We decided to do both and go with whichever one moved quicker. After Chasing both rabbits down the hole, the K-3 got to the Embassy first becuase the I-130 can spend a months at the NVC and the I-129F was there a week or two, so the K-3 got us the quicker interview date.

It will be interesting to see if your approved I-130 does get sent to the NVC. According to the press release it may well not be sent, rather the USCIS may hold on to it in anticipation that your spouse will obtain a K3 visa and prefer to adjust status.

It is no longer abnormal for an I-130 to be approved before the I-129f. What you may be missing is the the USCIS has made great strides in shortening the I-130 processing time from what it was a few years ago.

We're about to see what truly happens and if the K3 process is faster than the CR1 process.

Our CR-1 case was completed at NVC on Nov 15 and the I-129F for K3 was approved yesterday, Nov 20. We've been through the entire NVC CR1 process now and are waiting to see if the K3 or the CR1 will both be scheduled for an interview.

The K3 was originally designed to be faster, however, over the years the IR has been shortened.
