Hi all,

I have a question to ask and am hoping that you guys could help me out.

Some backup info first:

I got my immigrant visa and it said CR-1 because the day we started the process we had not been married for over 2 yrs. The day I entered the US, we had been married for over 2 yrs, yet the guy at the POE did not change it to IR-1 instead of the CR-1... I kept telling him that it was wrong and I should be processed as IR-1 and get a 10 yr greencard instead, but the told me to change it myself and he was very rude.

Fast forward till today:

I just recieved my Green card and it's only valid for 2 yrs. I knew they would mess this up and now I have to change it myself, which is a bit confusing to me.

I found out that I need to send the I-90; description below

If you are filing because your card was issued with incorrect data due to USCIS administrative error, you must mail a new I-90 application using Application Reason "d" My card was issued with incorrect information because of a USCIS administrative error, and any supporting documentation, to the USCIS Service Center/National Benefits Center (NBC) that processed your previously filed I-90 application. For the Service Center/ NBC mailing address, please refer to the letter that came with your I-551 card, also known as "Green Card". This letter provides the address for the Service Center/NBC that processed your previously filed I-90 application. The Service Center/NBC address can also be found on the I-797 "Notice of Action" issued for the previously filed I-90 application. In addition to the new I-90 application, applicants are required to send the original I-551 card containing incorrect information, and documentation that supports the requested correction. I-90 applications submitted with Application Reason "d" do not require the $70 biometrics fee or the base application fee.

The highlighted part is what I don't understand, I live in Los Angeles, but the Greencard letter shows that it's from Texas Service center... so I should mail the I-90 form and my Green card back to them???

does your original I-797 say TSC on it as well?
If they both do, I would send it to Texas. They will transfer it where it needs to go.
Just my 2 cents, I don't have a positive answer for you sad.gif

At the time your Visa was approved & issued, were you married 2 years?
Kez/JWolf
If you were married less than 2 years when you were approved for your visa then it is correct..... it is not based on the date you entered or recieve the greencard..... it is your date of approval...

Maybe you should make an infopass appointment and see what they advise you to do.

If you think the card is wrong then you need to file the I-90 form follow the instructions for errors on the card.... it should be maild to the address it came from....

Good Luck

In either case it appears she has been given the wrong visa

beetee, you got the right visa, but the wrong status.
I suspect that an InfoPass appointment would be the most direct way to fix it; the officer there can help you complete the form, make notes in your record, and make sure you're sending your request to the right Service Center.

I was told by an officer at my DO that all the Immigrant Visa Green Cards are produced in Texas regardless of your 'normal' SC.
