hey people, i posted this over again. i thought i would be coming back on here with some good news. but im not, my husband failed because the blood test found weed in his system. so i have no idea what is next. and thats were things are right now. im still in disbelief after all this time. ok later. thanks for asking anyway..what advice do you have on this?

I found form I-693.....What should I get from our doctor other than proof of the required Immunizations ???? Just wondering... I plan to send it off the the Dr. Micheal OKeefee that Jamie used, there are so many more items on the form other than immunizations, will he be able to complete the form without seeing him? I guess I'm asking you Jamie Thanks.

It appears the board went down while I was responding. I suggest the first thing you do is get him cleaned up.

I have a question, is this a K-3 or the CR-1. There is an available waiver now. http://uscis.gov/graphics/formsfee/forms/files/I-690.pdf Though I have never heard of anyone successfully using it. I believe you would be in a better position if this is the K-3, I find the wording very hopeful, to the point it might not even be needed. It states if the attending physician determines that the drug abuse/addiction is in remission you are no longer considered inadmissible.

This could come into play during the physical for the CR-1. This is of course what I am hoping for, see my timeline below.

Proff of seeking medical assistance for the issue would probably be good if there is a short period on time between attempts. Once approved you can sit on the I-130 for a year withough doing anything. But of course you should not have to wait that long.

My wife should have her phyisical this week. I fly down Tuesday. 2nd Interview (IR-1) this time, on the 7th of April. This has dragged on so long she will not have to deal with the Conditional Permanent Residency.

Did they tell him anything about a 3 year ban, that used to be the policy, and could be still. Back in 2004 there was no waiver available. So things have changed somewhat. Check back here on the 8th or 9th of April, I I'll have some kind of update. I moved back to JA a couple months after the wifes visa was denied. There was available waiver back then.

I think it would be good if we can get a warning about this issue pinned somewhere on this board, this seems to be the biggest reason for denial of a Visa from Jamaica... Gee I wonder why.

I always wondered how the rasta defense would go. Hey mon it's part of my religion. I always though it was absolutely rediculus, that back then you could get a waiver for HIV, but those devils that smoke Ganga we don't want them in our country. Funny thing is it's now using the same form as HIV.

I'm worried about this myself, this time around as it is before the 3 years are up. I plan on having the completed waiver form with me at the interview just in case.

I wish you luck, and I hope you do not have to deal with the seperation that this caused my wife and I.

Denise, I believe you need the SUPPLEMENT, its called I-693A I believe and our civil surgeons office had it. Its just a one pager that has a checklist. So silly really that its such an important thing, that lil form.

Hi Eric, thanks for your reply. this is for the CR1 and they told him he could not apply again until 2009. he said the gave him a letter about how to appeal. i dont understand how does the waiver work? i am planning on going down in a couple of weeks. so i would like to see what i can do on this end first before i leave. will the waiver help him to come. thanks

I find the fact they gave him a letter explaining how to appeal promising, I think the first step is finding out what the letter says. Back in 2004 there was no options.

You should not have to file again to appeal.

I already have wacko.gif plus I'm not working. I was a social worker for 25 yrs. I just applied for a bartending job, either I'll work myself to death or drink myself to death, anything to alleviate the boredom.

Some people AOS cases are transferrd to CSC then approved without an interview. Their green card just show up in the mail. They are lucky.

Anyone know what I put on part 4, section D-poverty guidelines of I-864 affidavit of support form?? Number three where it ask about the min income requirement for my household size(5). I am sure it will be based on my income, but is there a chart some where?

Also seeing as I will not most like file my 2005 taxes in time, Should I leave out my 2005 information all together, and just go with 2004,03,02?? Or send the 2005 w2's without the return.

I would send the 04', 03', and 02' tax info AND your 05' W-2. It can never hurt to have too much information. Regarding the poverty guidelines, if you do search on the web, you should find the national guidelines.

I have good and bad news. GOOD NEWS. Rohan picked up his paket 4 today biggrin.gif . I scheduled his medical they said the earliest is April 6, but his interview is April 13, is than enough time? hmmm

Bad News

sad.gif Rohan was trying to earn some extra money (to help with the expenses) by doing some painting at church. He fell off a ladder and broke his left hand sad.gif . My baby is in sooo much pain. The thing with the hospital is that if you dont have the money they wont treat u. So he went to the hospintal for 1000 they gave him an injection 2000 more thosand just to register him, then they said his hand is broke and SENT HIM HOME mad.gif , and said if you want to see the bone specialist come back Thurdsay and it will be 20,000. He is in PAIN, how can u send someone home with a broken bone, is beyond me. mad.gif . Not just that look at that kind of money we already were short of money and I have no support to help me financaily with all the expenses. I just found out 335 US for Visa form 100us to paymaster 200 for physical and this does not touch his plane ticket. hugggghhhh. Well what to do. Please pray for Rohan to get well soon

thanks for all your prayers and eric's information has given me some hope. i was so overwhelmed about the situation. its is really hard to deal with. but now i see it might not be so bad if i can appeal it.

I'm so sorry to hear about your honey sad.gif I can't believe they didn't set his bone back in place and put a cast on it! What's he gonna do now? It won't heal right if they don't set it. The entire health care system in Jamaica is so jacked up. That's one of the reasons I could never live there. I'll keep you guys in my thoughts.

I do not believe you have to pay the $335 for the K-3, that is for the CR-1. You just have to pay it later when you file AOS. They make sure they get you one way or another.

Tenika -- So sorry to hear about Rohan's hand. That really does SUCK that everything is so much about the $$$ Hopefully everything will be okay with that.

But your Good News is really great!! kicking.gif Yes, that is enough time between the medical and the interview. They never schedule them more than a week before.

For Paymaster you only need $100.00 (not the $385 -- that's for the Immigrant visa classification). And, if it makes you feel better, we thought Roy's medical was going to cost close to $200US and it only cost him (about) $135.00.

Please allow me to divert a bit form the normal flow of this thread..................

I am very frustrated now.................I've been calling the doctor's office since last wednesday to make my appointment fro the medical and the receptionist keeps on taking my number saying she will get back to be because the person who is in charge of scheduling my appointment is not available no one called me back so i went in to the office this morning and to my surprize the lady told me that they are all booked out for this week and it will be too late for next week because my interview at the embassy. However i called somewhere else that is over a 100 miles form me(i'm in trelawny and this place is in kingston) and they gave me an appointment date for the 27th but when i hang up the phone i realized that the 27th is just 6 days from the interview and the embassy stated in package 3 that i should do the medical at least 7 days prior to the interview..............now i'm worried that i may have to be schedule for a different interview date.

Yes that sucks, I'm sorry to hear that. It's true that they don't do much for broken bones other than to set and cast it, even that they do based on the type of break. Hopefully it wasn't a bad break and will heal fast.

Having at least seven (7) days before the interview is preferable. Nobody will make the appointment for much more than seven days before. Six days shouldn't be a problem.....if you go to the interview and the "medical" hasn't been received yet they will just have you come back. You will go through the rest of the interview -- just won't be approved "pending" receipt of the medical results.

I believe this happened to someone last November/December.

I hope that it does heal correctly without them setting it. I am angry about this. My poor boo. crying.gif I told him to go back to the hospital. I hope they were incorrect in saying it is broken, The medical system there needs help. We are blessed to live in a country where they have to treat you first, then worry about the bill later.

ERIC- I hope you are correct about the $335. I really cant afford it. but it says I need it on the check list

In packet 3 there is an Attachment which says..under the section Your Visa Interview, it says

You must also bring the following forms. If you do not bring them, YOU WILL NOT RECEIVE A VISA
1. US$335 (or equivalent in Jamaican currency at rate of exchange used by the U.S Embassy) for each applicant'S immigrant visa fee
...

I also just realized one of the forms, say I need an I-134 Affidavit of Support and the list above number 10 say I need a I-864, which one did you guys turn it?/

Hi Maria, I recommend you talking to Jill (christinejames) in this case. Her fiance was also denied due to weed in her system back in Apr 2005 and was also given the option to appeal. Well after talking to lawyers and the CO in JA she realized there was nothing she could do. I don't remember everything that happened so maybe you can email or send her a PM. I'll also tell her about your case.

Guys I really need your help with this.......

I submitted the I-131 along with the AOS & EAD. I accidently checked off the wrong box
[x] I am a permanent or conditional resident of the United States and I am applying for a reentry permit.
I was sopposed to check
[x] I am applying for an advance parole document to allow me to return to the united states after temporary foriegn travel


Now i need help. Can I just resent it to the lockbox with copies of the NOA1s for the AOS & EAD that i recieved?
The letter that came back states that it was a "Rejection Notice"....
I still dont understand how i made such stupid mistake my husband is going to kill me when he gets home.

Having at least seven (7) days before the interview is preferable. Nobody will make the appointment for much more than seven days before. Six days shouldn't be a problem.....if you go to the interview and the "medical" hasn't been received yet they will just have you come back. This happened to Anthony. He had his medical 7 days before the appointment and the Embassy had not received the report when we went for the interview. They told us to come back at at 11:00 am on a Tuesday and then they took the first 60 in line. regardless of the appointment time. We got approved after the third visit to the Embassy (the day before I was returning home).

I called the National Customer Service number this morning, after pressing numerous buttons in an attempt to speak with a live human being, I sat on hold for 25 minutes only be told absolutely nothing. I drafted a letter, made copies of all my NOA's, rejection notice, copies of cancelled checks and the original ap check for $170. It's going right back to the PO this afternoon. I swear I can't wait to be done with the USCIS....All this money and they STILL can't get it right. The rep on the phone was so nasty and unhelpful. I don't even see the point of having a customer service line. All the info they give you you can get from the automated system
