Hubby hasn't filed his US taxes for the past 5yrs. Only because we weren't aware that he had too until we looked into getting my visa.

I've contacted a few people here in Australia who specialise in US taxes abroad and some are saying they'll do the 3 years needed.

If he hasn't filed for the past 5 yrs, should we file 5yrs worth, or just the 3 we need for his visa? Because the way the tax people are talking they said we only need to do the 3 we need for my visa.

BUMP! BUMP! BUMP! I would be very interested to see some responses to this post. DH has also not filed in the past years, as he thought he didn't have to since he has been filing with Canada Revenue. Wisdom, anyone????

You may be able to get away with filing for just three years for I-864, but it will be a really good idea to come clean with IRS. If you owe taxes, the penalties could add up and the amount you owe could double in 5 years. So, I would recommend taking care of it as soon as you can.

Agree. Living and earning money abroad does not exempt a USC from filing taxes. That's why they have forms for filers abroad at every US Consulate. Do it now for all five years and clean it up - not only will the penalties and interest really add up, it's just not smart to not file taxes.
