Well the wait was just too long so I came to Mexico to stay with my husband while we did the visa then decided why not try living in mexico and not go back to the states. Finally decided I just couldnt be so far from my family. So we continued the process(see timeline). I put my father as additional household member on the I864 and now Im worried since I have been living in mexico with my husband that it will be a problem? Also can I continue to stay in mexico until the interview or is it nec. that Im living in the states.
Thanks Becki
Becki,
Do you live with your dad currently, when you are in the US (ie, your last US address)? Do you and your husband plan to live with your dad when youg et to the US? If yes, I think Dad can be a household member. Are you living in Mexico on a visa of some sort? Like FM-2 or -3? Or are you 'just visiting'?
There is an important distinction between residence and domicile. If you have not cut all your ties to the US, you likely have retained your US domicile and are 'temporarily resident abroad' or are 'just visiting'. Look in the DCF Guide--I have some links regarding domicile in there at the bottom.
