Unfortunately, I don't think you'll get anywhere telephoning the Embassy. We've been in limbo since March. Email the Embassy with your inquiries or call the Department of State. It's about all you can do and as you know they won't tell you much. Have you contacted your senator for assistance?

Your information in your post says you filed a CR-1 ....is this correct? Did you file for Fiance Visa K-1? Maybe if you provide a little more information someone can help you. My husband went through the Cairo Embassy. I would be more than happy to help you.

1. Exactly what visa did you file?

2. Have you recieved anything in the mail?

Hope to help you , inshaAllah.

JUST READ YOUR TIMELINE, YOUR CASE WILL BE DIFFERENT BECAUSE YOU ACTUALLY GOT MARRIED IN EGYPT. CR-1 VISA IS WHAT YOUR FILING NOW. I WOULD E-MAIL THE EMBASSY AND ASK THEM FOR AN UPDATE ON YOUR CASE. I HOPE EVERYTHING WORKS OUT FOR YOU.(INSHAALLAH)

i first filed for a fiancee visa in dec2005 and that is still pending in cairo. then we got married in feb 2006 and then in aug i filed a spousal visa . i got my reciept number but did not get a case number as of yet . they said it will take 4 to 6 months for this.but cairo is still working on our fiANCEE VISA.its been since june 26 that he has had his interview and are getting really pissed about the whole waiting thing mad.gif

This is a very odd situation. Did you tell Cairo at your interview that you had already gotten married legally and filed for a marriage based visa? From my understanding, you cannot get a fiance visa after you've been legally married.

my husband had the interview and didnt tell them we were married . but they know because i sent them emails stating that.they should knowanyway we are registerd and they keep going with the fiancee visa. eithier they are dumb or just plain lazy to look it up

My guess is that they've put the fiance visa on hold now, since it is only for legally unmarried parties to enter the US and get married.

Email the embassy and ask them what's up. Explain that you filed 2 different visas, that you had the interview, and you are wondering if the fiance visa has been shelved.

When did you send them emails saying you were married? Your husband should have told them up front at his interview that you were married. I think this will cause a lot of problems, because if he refered to you as his fiance, he was lying at the interview.

I'm no expert/attorney, but I think it's a bigger issue than that. Why would you file a fiance visa and then marry 2 months later? It sure wouldn't speed up anything. To have married and and continued to persue a fiance visa when you were no longer fiances may (not saying it will) be construed as fraud. My understanding is that once you marry, the fiance visa is void and you must restart the process. So if the spouse visa was just filed in August of this year, then it sounds like it is within timelines and not unreasonably delayed. I think the new peition has to be approved again in the USA and then forwarded to the embassy , as if it were a new case. But someone with more knowledge may come along and correct me. I suppose all you can do at this point is follow through with the advice already given and email the embassy to make sure of what is going on. Good luck to you in finding a solution and getting reunited with your husband.

You need to make sure the embassy knows you are married and cancel your fiance petition.

Why on earth did your husband have an interview for a fiance visa when you are married and your spousal visa hasn't been approved in the US?

YOU NEED TO TELL THEM YOU CAN'T JUST SAY THEY ARE TOO LAZY TO LOOK IT UP!

My understanding is that once you married your fiance visa is no longer pending. It is cancelled. You have to now go off of your timeline from when you filed the Spouse visa, which I believe was Aug. So your wait thus far is not unreasonable. Why did you abaondon the fiance visa that was already in process to start over again??

you knwo u need to withdraw your K1 petition and file a CR1 or K3. the terms of the K1 is strictly to allow your fiance to come to the US to marry you IN THE USA. the K1 is defunct now and its probably taking them awhile to figure it out.

what exactly is your senator helping you with? Your visa application is defunct. period.

In any event, even though you may have messed things up it does look like you're back on track. Unfortunate that by getting married you delayed the process but hindsight is 20-20 and what's done is done. The important thing is that it has been approved and now it's on to his interview once you gather the info together. good.gif

I sent emails and letters to the Prez, Condi, DHS, the Gov of my state. I got back some form letters thanking me for contacting them but I've gotten a BIG FAT ZERO from them. sad.gif

My Congress Rep helped get our file out of the local CIS office and on to NVC, but said they couldn't do much more once the file went overseas. They did write a letter asking to process as quickly as possible since we've been "in the system" since 2001. Not only did that not help, but we were on AP for over a year!
doodlebug
I've been lucky since Vermont was so quick and the only hold up so far has been on our end, but if and when our AP time gets to be enormous I kind of wonder if contacting anyone will actually make the people in Cairo mad. I have pictures in my mind of them being put off at that and then sticking our file in a drawer just to spite us. Hopefully it won't come to that but I really feel for those who have waited over a year. I think that will be my breaking point. I can handle the wait now 'cause I'm really busy with work, life, etc. and because I'm seeing my husband in less than a month but I know that once I come back it's gonna get a lot harder.

You know occasionally the President will answer his own mail and messages. I have a friend that is married to an Algerian. She was raised by her grandmother because her mom died in an car accident. One summer my friend, her husband and son went to Algeria and stayed about a month and they were having so much fun that they never checked in with the grandmother. The grandmother became worried and called the White house and left a message saying her granddaughter and family went to Algeria and she has not heard from them and she was worried. One day Mrs Peggy got a call and it was President Bush himself. He told her he understood how our children make us worry about them and that he would contact the Embassy in Algiers and let her know something soon. A day later, she received another phone call telling her that they had located them and they were all well and enjoying their vacation. Needless to say they never neglected to call her again.

It's been really tough at times because we only get to see each other for two weeks out of the year. I used to do alot of volunteer work to keep myself busy when I wasn't working.

Interviewed for a fiancee visa but didn't tell them that you were married??
Do you understand that this is misrepresentation, and it would have been visa fraud if he had actually received the visa and tried to enter the US??

You may hear something soon, but you may not like what you are going to hear. You should seek the opinion of an experienced attorney before you guys try a second interview. If they realize that he actually interviewed for a benefit that he was not entitled to, and misrepresented himself, that this equates to a lifetime ban.

Good luck on this one..

sorry for all the confussion blush.gif i applied in dec/05 for K1 it was sitting in cairo embassy from feb 2006 thru till i withdrew it dec 2006 . nothing was getting done just sitting on someones desk collecting dust. so we got married and i applied for the spousal visa and it was approved june 5 2007.20 days it took to the date at the california center . vermont had it for 10 months without processing it so it was transferred to the calif. center no time and we were approved.now we are waiting for the packets from the nvc . then to cairo again. hopefully he will be here by the end of the summer. sorry to all i hope i cleared it all up for you, micky good.gif

MABROUK micky... I know you have ben waiting a LONGGGGGGGGGG time... hopefully your processing will speed up smile.gif

thank you mabrouk. as os june 21 my case is finally at the national visa center.i am so excited i can see the light in that long tunnel now lol.and i got a letter from the president telling me he has contacted the homeland security to find out why it was taking so long. last week i got a letter from the vice president. so if you are having troubles email everyone or write letters to everyone you can .. it helps
