Full Version: After marriage, is it allowed to leave US?

Hello!

Maybe this has been asked before but I have not seen it posted, sorry if it's a dup...

If the K-1 has been approved and we get married, could he go to The Netherlands to visit his family after that? Is there a waiting time before he can return to Europe? Your help will be greatly appreciated!

After he is changed to permanent resident status or you can file for advance parole if you have to go back for some reason.

He can not leave the US until either you have filled for AOS and AP and the AP has been approved or AOS has been approved and he has his greencard....

If he was to leave before he got AP then his AOS would be abandoned and he would not be allowed entry.... and you would have to start all over again..

Once he has applied for and received advance parole, he can travel outside the US. If he leaves without advance parole, he will not be allowed back into the US.

Most aliens who have pending applications for immigration benefits or for changes in nonimmigrant status need Advance Parole to re-enter the U.S. after traveling abroad. Aliens applying for advance parole on the basis of a pending application for adjustment of status must be approved for advance parole prior to leaving the United States in order to avoid the termination of their pending application for adjustment

Aliens in the United States should, prior to departure, obtain Advance Parole in order to re-enter the United States after travel abroad if they have:

Filed an application for adjustment of status but have not received a decision from the USCIS;

OK, I feel stupid asking this, but I can't seem to find the info: after my fiance receives his visa and we marry in the u.s., do the AOS, and he receives his greencard (I guess this will be several months after we get married), he will be allowed to travel outside of the U.S. and come back on his greencard, right?

We would love to be able to visit our friends in Europe next Christmas. I assumed once he has his greencard this will be possible, but correct me if I'm wrong, please.

Also, is travel to Puerto Rico considered travel outside of the U.S.?

Yodrak you are right.... I should have said "You should not leave" not "You cant leave".
