I really need some help...

My fiance is currently in India, and we plan to get married in December 2007.
My question is that he is planning to apply for visitor visa to come USA, as we want to get married here...
But there are doubts from his lawyer, stating that if his visa gets rejected to come to USA, and when we will apply for him through spouse visa there are good chances that it will be denied since he will be having a rejection stamp of USA.
He already has a rejection stamp from UK (about 9 yrs ago)

DO you think that the statement is true? can they reject a spouse visa just becasue the visitor vsa was denied???

In my opinion it would be best to apply for a fiance Visa, get him here in hopefully quick timing, then marry here. Using the Tourist and or other Visas for Marriage can be considered fraudulent and be cause for Visa rejection. In the time it will take him to get the Tourist Visa, if not less, you can get him in on the K1.

I think your current plan is a bad move.

I agree. I think you should apply for a fiancée visa so you can get married in the US. You have plenty of time to get that if you only plan to get married in December 2007.

The US immigration can do all they want, even reject a spousal visa application if they want to.

Your best bet is to wait on the K1 to marry in the USA. Men coming from India and Pakistan hardly ever get visitor visas and having one denial could impact your K1. Good luck on your journey.

Consulates can pretty much do what they want without any supervision. Is it really worth the risk? I would listen to your lawyer.

I agree with the rest, K-1 will be the way, it is legal, risk-free, faster. But also keep the following thing in mind:
1. Did you saw him before or it is online affair?
2. You will have to show lots of evidense to support your petition at the time of interview becasue I know my friends from india.

On the good side: k-1 and rest of visa process in India will be very very fast starting 2007, look for info on mumbai embassy website, they are going to cut about 50% wait time so good luck.

I have known him for about 9 years now.... We met when I use to live there,and I travel every year so we do have plenty of evidence to support our relationship...

My brother is getting married in America as well as in Canada in Jan 2007 and I really want him to attend the wedding, and I know Fiancee visa will not be approved that fast, so we were thinking of having him come here through Visitor Visa....

Do you think if he applies for Canada Visa, and gets rejected..... can I still apply for K-1 visa....would this impact anything...having 2 rejection stamps on passport??????????

One more question..Does anyone know what are the requirements to file for spouse visa from India....
