hello, can anyone help with advise on what to do as my case has been in administrative review for 6 weeks with the fraud prevention unit. i cannot get any answers from anyone. i am at a loss as to what to do!! and how much longer do you think they can drag this out?

It can take as long as Home Land Security and the FBI needs, a few weeks, months, even years.

Once your case goes into Administrative Processing or to the fraud unit you will not be able to find out anything until they are ready to talk to the SO again. You can have a field investigation to the SO job, home, or neighborhood. You may have to go back for one or more interviews to the embassy as well. I know of three fraud investigations that were marriage based out of different embassies. One CR1 is in the states now. It was over one year before they were approved. Another one the husband was already married in his country and after investigations close to one year they were called back to the embassy and denied. Another case they submitted documents the embassy deemed fraud and many flags and they were denied and may or may not appeal.

One K1 the SO had to go back for a second interview and their case was with the fraud unit for three months.

thank you for the info. it has been 8 weeks already that my wife's case has been with the fraud unit because i had tried to petition for her 8years ago and she was denied and for some reason that first case is still open and they said it would be 1 to 3 weeks to close that and they said she passed the fraud section but had to wait til they contacted her. it has been 2 years since i first started the petition this time. it is such a very long process!! again thank you for the reply, brian

My guess would be they can drag it out as long as it takes for them to verify what they are looking for. I wish you would put up a timeline so we can tell where you are in the process, kind of hard to help if we don't know what stage of the process you are in. I too am in Vegas.

hi thanks for the reply. i filed the petition in dec of 2004. it took til oct of 2005 for the immmigration to approve the petition. national visa center had the case from oct 2005 til march 2006 where the case was complete. she was scheduled for an interview sept 13, 2006 and told to return sept 18th where she had an interview with the fraud prevention unit. she then was told we had an open case from a prior attempt. do you or anyone else know of how long this could take. i have made several calls to the embassy and they will not give me any information.

Once it goes to the fraud unit there is no time limit for them to be done processing. It will depend on how many open cases they have and will they go out and do field investigation? All you can do now is be patient and let them do their investigation.

How do you know if your undre AR at uscis and what is a fraud unit and how do people know if they are sent there?

i only know beacuse my wife was sent to the fraud unit and was told we still had our previous case was open cuz she was denied before so i kept calling as they told her 1-3 weeks and it has been 2 months. so after calling MANY times of calling they told me that. otherwise you will not know. there is no one to get any real answers from that is what is soo frustrating about this. there is nothing you can do but wait. they do not even tell you the proper sequence of times. hope this helps. call the embassy. we have been trying this time for 2 years. good luck!!!brian

Nice 2 c u again i m still waiting for my NOA2 but atlast i got touched twice after 83 days i never thought ti take so long for me to get my NOA2 and still the big waitng still had to come when i also be under administrative review i want to ask u regarding this about fraud that how come they think that that this K1 visa case is fraud or not like i know me and my fiance are true lover and what ever they want investigation do on me they found that i true K1 visa seeker and want to be with my future wife so pls tell me on what ground they think the case is fraud?

AR can happen at any stage of the processing. The fraud unit comes into play once the case goes to the embassy level. At the time of the interview you are given a 221g and they will say your case is on AR/AP. And if they truly doubt the relationship they will say they are handling the case over to the fraud unit. In most cases those that go to the fraud unit have to wait until they do field investigations and then will have to come back and have a second or even more interviews before a decision is made.

If you have very large age difference, the marriage happened in very short timeframe of meeting, not enough documentation of ongoing and prior to marriage contact are just a few things that they look at especially coming from the ME/Asian/Africian embassy.

If you look at the statistics for the Islamabad forum and the Indian forums as well you will find that the men from these countries have to endure AR/AP for some length of times. In our case we were legitimate and we were on AP for almost 5 months, Chaurans from India on AP for almost one year I think, and many others from the Islamabad forum still have thier lives on hold. Ali a K-3er this week just was issued his visa and was on AR and AP for 364 days.

All anyone can do is wait out their processing, stay positive and keep your conversations light with your SO and know you will endure AR/AP from these embassies. Pray for patience and do not set event dates that can come and go before your visa is in hand it makes the waiting that much harder. I try to stay and sound upbeat but I had my days and if you let it get to you --- you will be depressed and get sickly. So I was not Mrs. Sunshine while we were processing.

I've been married before (via K1 Visa) but got divorced when things didn't work out, so I wasn't able to process my Adjustment of Status (I-485), so I went back to the Philippines, After 2 years, I met my fiancee and he petitioned me (K1 also). During my interview on July 28, 2006, I was asked to submit a copy of my previous I-485 (Adjustment of Status) but I don't have a copy of it so I just submitted a letter of explaination last Aug 31, 2006. I just called the US Embassy Manila and they said "It is still under review. Just wait." Is this document required for approval? Cannot they look up that information in their system? I made a request to the National Records Center for a copy of my I-485 I submitted back in 2001 from my first marriage but the doc request list waiting time is so long (1yr). My fiancee asked for the congressman's help but the request still on process. What shall I do next?
