I know this is a very specific question but has anyone filed to lift conditions based on a good faith marriage and was granted a 10 yr green card WITHOUT an interview? I know that's wishful thinking but I'm just pondering the possibility. Does divorce automatically send a red flag, thus an automatic interview, when it comes to lifting conditions? Or is this common enough that USCIS knows what they’re looking for and may not require an interview? I'm basing this on the fact that a good faith marriage clause does exist in lifting conditions. Any thoughts?

Many are adjudicated without an interview. It depends of the sufficiency of the evidence of a bona fide marriage.

Is this for your husband, the one you still want to get a GC for?

There was one person here on VJ but she said it took approximately a year and a half from the time of her application until she was approved...

Yes, as a matter of fact, we received our 10yr approval letter in August, about 4 months after sending in our last batch of evidence. My husband made an infopass appt, took his 3 photos in, handed it all in, they took his old card and said his new one would be in the mail in a few days, which it was. No interview. They do have 3 years of "evidence' in the forms of reams of paper, but no interview.

Most couples that are still married and jointly & correctly file the I-751 are approved without interview.

This OP is asking about those who file after divorce, on the 'good faith' waiver.

hmm, the OP asked 3 distinct questions, I answered the first one. He also asked about divorce but did not say divorce actually ocurred.

That's great, but you might have missed the OP's other queries perhaps?? Or the topic of this forum and why people post their queries here?? Just a thought, but hey, that's just me... your mileage may vary...

Nope, didn't miss them, just answered his first question. But it's great you have the engery to police the posts and follow up with insulting snarkiness. Not to mention the fact that I didn't express whether or not there was a divorce or such a proceeding in my case, but you can continue to assume my answer is baseless and off-topic.

Nope, I sure can't match you for "snarkiness", it seems... whatever that might mean, since it's not a word in the English language.... so I'll just assume it's not positive...

Maybe if you state the facts relating to your situation as it relates to the OP's situation, it wouldn't be considered as either one of those. And you said you answered the 1st question. Unfortunately, no one around here is a mind reader that I'm aware of.... if you care to elaborate, that's up to you, but answering one question out of context from the rest of the post doesn't do the OP much good, imho.

But hey, as I said, that's just me, and your mileage may vary.

Yes! good.gif and it happened to me. In fact I was approved in 6 1/2 months after filing it with a waiver.I had an RFE but was granted with the 10 yr card WITHOUT an interview this Feb2007. I believe it depends on one's case though and that includes evidences of a bonafide marriage etc...
