So I am a dependant of my parents in my income taxes since I am still in college (and they are against my marriage so they will not give me a copy of the 2005 income tax returns) which it says I need for the interview? Are they completely necessary? WHat should I tell inmigrant officer? Help!

You will have to prove that your SO wont become a charge of the state, If you don't have sufficient income and assets to support the beneficiary, and are unable to get a co sponsor you will be denied flat out, nothing that you can say will change it.

Also you would need more than just your parents 2005 returns, you would also need them to fill out an I-134 to go along with.

The only thing I can think is if your fiance has enough assets to suport him and you and has a good job prospect then maybe they would consider that.

We already have a joint or co sponsor....his aunt is his sponsor, and I am the petitioner, she has big enough income that if anything happens she could help my husband economically....is that the only thing we need? our interview is coming up this month...

That is correct any one can be a co sponsor if they are willing, you may want to explain the complete legalities of this, that signing an I-864 form is legally binding and that they will be responsible for support for up to 10 years. You will also have to fill out an I-864.

You will also have to fill out an I-864.

unsure.gif We didn't need to fill out an I-864 for our I-129F for K-3, only for the I-130.

His aunt already filled out and signed the I-864 as being responsible for him in case it is needed...it was sent with all the papers and we also have a copy of it...is that all we need for the income tax? Does that mean that me not having the income taxes from 2005 will not be a big deal? Thank you so much for your responses!

Did you not work at all while in college, even a part time job? If you were not required to file a return because your income was too low, attach a written explanation.

I have a part time job, but is work study so it doesnt count, it goes straight to college...nothing to do with taxes.
