Good luck on the petition fee, they did us a huge favor by accepting our cash, I'm sure they only did because it was a particular situation, but again ask. They are always very kind and helpful. As for the BC, simple, we went to the County Hall in his birth city, the records office and asked for the BC articolo 3, we specified that we needed both parents names included and they pulled it up from their files and printed a recent BC, I think it might have cost a couple of Euros or so.

In the Packet three they sent, they requested a recent marriage certificate.

Good to hear your starting to get those first steps down.

Hi Breezy,

Hot in Milan too.
But I just arrived in the US for a visit. It's 3am and I'm awake with jetlag.
We're getting everything together to petition in September. I'll get a cashier's check for the fee while I'm here. It would be cheaper to go ahead and start in July, but we think September's probably better for our timing. Hopefully, we won't hit delays that make us wish we'd done it before the fee change... Oh well, you gotta make the choices that seem right at the moment and then work with the consequences. Will keep you posted.

Okay, this is the third time I'm posting this question, since my head is in the clouds today and I keep posting in the wrong place.

I'm looking into refundable plane tickets. The interview is on the 23 and 24 of July, and I wanted to buy the plane ticket for the 28th. What about the brown envelope? Is it given upon return of the passport with visa? Or is it mailed at a later date?

I found a good deal on the ticket (by good deal in July, I mean 1000 euros) and I wanted to book as soon as possible.

star_smile.gif No, you do not have to fast, interview pack specifies that you don't have to, sorry that you haven't got that packet yet. In a nut shell it says that you'll need the Vaccine Certificate from the ASL for the Medical, 180 Euros, pictures (how many, was it 1?)Interview: origional documents for them to verify the copies that you'll give them, asked for passports, marriage certificates, divorce certificates, any military or court documents, husbands Birth certificate (the one with his parents names and places of birth). DS-230 form 1 and 2 (we faxed them part 1 like they asked but found out thtat they didnt have it on file.) part 2 unsigned, evedience of relationship, I-864's.

When you reserve the room, say the room is for __your last name___/__his last name__. Or when he checks in, have him give them your last name for the reservation and then he'll give his documents. I really don't think they'll care who's staying in the room as long as it's paid for, lol, and they're not all that strict here in Naples, I doubt there will be any problems. Just explain that the credit card last name and the person staying's names are diferent. Dont sweat the small stuff, if i were you i would make the reservation and payment over the phone, that website with out the contact number seemed a little strange to me... Good Luck on that part!

hotel and was told it was fully booked crying.gif , online it shows that they have rooms available blink.gif
this mornning, he called an old friends of his huh.gif, and she managed to book another hotel for him , not sure about the hotel name yet he will call me tomorrow about that info.
it seems like it should all work out just fine, and yes I don t know if we can trust that site either cool.gif

helpsmilie.gif I am in dyer need for a little advice. I am married to my Italian prince and we are both living now in Italy. The original plan was to get married here and get his visa through direct consulate. Well, it seems as though that fast track may not exist here in Rome. I am anxiouse to get back to work in the states. I was advised to apply for the I-130 then when I recieved the notice apply for the I-129F. This is supposed to be the quickest way for us to leave the country. My concern is would it be smarter for us to stick out his I-130 here in Italy? May it be a quicker and easier process for him to recieve his visa here in Rome? I asume since I live in California finishing our visa journey there may be a long long complicated fiet. I have been holding on to these forms for 2 months anxiety ridden with what to do. I don't mind sticking things out for the next 6 months or so if it will may life less complicated in the end. Please, please I beg anyone with any tid bit of info for a moment of your time to help. Thank You helpsmilie.gif

Hi Colgirl,
I have not yet started the process but my understanding is that you can go through the process for an immigration visa (IR-1, or CR-1 if you're newly married) in Rome if you are already married and if the US citizen is resident in Italy, i.e., has a permesso di soggiorno. The I-129F has no part in this process, as far as I know. The I-130 petition needs to be submitted to and approved by the USCIS office in Rome (at the Embassy) and then the visa interview will happen at the US Consulate in Naples. You (the US part of the couple) need to be resident in Italy for the first part of the process, the petition approval in Rome. After that, I imagine you could leave and go to work in the US... In fact, it might help your application since you'll need to show resources to support your husband in the second part of the process.

As I said, I'm no expert, because I haven't started yet. But that's what I understand.

yes I believe your best bet is cr1 and so do I130 alone..the process realy doesn t take longer than the k3 that you will have to adjust later ...if you are willing to wait a couple extra months, it is a smart way to go .

Hi and welcome to our little bunch, glad you found your way here. In no time you'll sort your options out and find the right one for you and your husbands needs. Don't put too much worry into the process like I did, you'll see in the end that it wasn't that bad at all, quite simple once you get the hang of things really, so set your worries aside!

whattodo did a great job of explaining things, nice and simple unlike me....

First things first, do you have a permessio di sorrgiorno/Permit of Stay in Italy? You'll need that to be able to use the DCF option.

You mentioned "Well, it seems as though that fast track may not exist here in Rome."
If you are talking about DCF an option in Italy, Rome/Embassy just takes care of the first thing you will file, the I-130. I believe yes, Italy still offers DCF or have things changed that much since I filed? Here's the number I called quite often: 0646742190

You will send just the I-130 form and the documents they requested to the Embassy in Rome who will process just those papers. Looks like they take about a month to be approved. After approval, they will contact you stating that the I-130 Petition for Relative was approved and sent to the Consulate in Naples for further processing. In my opinion, all the staff at Rome couldn't have been more polite and helpful. I'm thankful I was able to call them for any concerns or questions.

Naples, will take care of the other forms and surprisingly was also wonderful to go through in my opinion. Yes, they were slow sending us papers, but in reality we didn't need to wait on their papers because you can download and print everything you need from the internet! We were assigned an interview date really quick too. There are easy as cake to contact for questions on Tues and Wed, and are SO laid back, they asked for those required documents at the interview, (birth certs, marriage certs, etc. ) and that was pretty much it! I'm sure every case is different, but if yours is straight forward, they will be staight forward also.

Our whole process took 3 and a half months! They estimate that it will take 4-6 months. That wouldn't happen in the U.S. as far as I know it's more like 6+ months!?! It would have been even faster for us if the Adam Walsh Act didn't confuse and put a hold on things at the Rome Embassy for us! You can look in the processing times or the immigration timelines tabs at the top of the page and get a better idea as to what the california service center looks like. I haven't done my research, but in my opinion DCF is generally alot faster!

You might need to consider the I-864/Affidavit of Support, it is a form stating that the spouse immigrating will not become a public charge in the U.S. (ask for food stamps/other help from the U.S. goverment) You will always be the main spronsor for your spouse and only U.S. income is counted. If you have no or not enough U.S. income (i think its some where in the 16,000$'s per year or xxx much cash) you'll need to get a joint sponsor who is a U.S. citizen and makes more than that to support your spouse.

If you just do not have anyone to be a joint sponsor THEN I would consider you going to the U.S. continuing to work for the I-864 purpose, keeping the 16,000+ amount in mind.

So my vote is DCF. I'm thankful we were able to do it! But then again I don't know so much about the U.S. route, can your husband be in the U.S. during the process over there? I thought no, but I'm not sure. All i know is that it seems to take longer. Sorry I'm not much help, you might try to post there too and see about others, or check peoples timelines.

Another thing i wanted to add. If your married for less than two years at the time of the visa approval, (called conditional) your husband will later adjust status in the U.S. if instead you are married for more than 2 yrs at time of visa (called unconditional) then he will not havve to adjust status later.
cr1=conditional=married less than 2 yrs and ir1=unconditional=married more that 2 yrs.

So, I would suggest the DCF Italy route to everyone! lol

My husband's interview is in one week. We have yet to pay the 100 dollars at Banco Nazionale di Lavoro. What does he have to say when he goes there? (In italian, please!) Does he fill in a form, or just simply tell them that he has to pay the visa fee?

I'm just a little concerned about the affidavid of support. My taxex for the last several years I have made plenty. But, now I work here and it seems that I can not use that income. But, I will leap over that bridge when I get to it. I only pray once we get all this I-130 paper work done things will move quickly. Any advise on wheater I should include photo's or extra stuff to prove our case with the I-130? Either way I think I'm ready to start the process. I'll keep ya'll updated. I am not sure as far as the fees because we filled for cr1 and not the k3 and so the only thing that my hubby payed for was the medical exam and veccination fees and that was about 235 eu and he payed cash NO PROBLEMS .

if you are filling for the cr1 like we are ..I wouldn t count on the embassay sending any packet...email them they will send you an interview letter and that all you need . all the document you would need are the ones sent with the ds 230 part I document instructions and download the ds 23 part II ....ds 3026 for the medical exam
that is all you need NO 156 that is for the k 3 visa not the cr1 okay

That's so wonderful to hear...when is he flying to the US?

Quick question for you, do you know if they asked for your husband's Permesso di Soggiorno? (I think I remember you saying that he is a foreigner in Italy)...We're just not sure if that is something he should bring...my husband has had the "striscia" for almost a year now, and his permesso di soggiorno isn't ready yet, but it's already almost expired and he hasn't even gotten it!

Did he have to show his original birth certificate or was a copy okay?
I've been a disaster b/c my husband lost his birth certificate and had have his aunt in Ecuador get a new one...she sent it in the mail but it still hasn't arrived yet. We have copies of the old one. I'm going crazy, I can't believe this is happening!

I had printed the ds 3026 and send it to my husband not sure if he would need it , as you know we never received the interview packet. the doctor and his help help him fill it out, but he was told he was supposed to fill it out before getting there.
it is a very simple form that asked questions about health history.

well to answer your question, he wasn t asked about the permesso di soggiorno but he had it as well as his work certificate. I hope they won t ask your husband but I believe he should have a receipt for his filled permesso that should do smile.gif

Did he have to show his original birth certificate or was a copy okay?
I've been a disaster b/c my husband lost his birth certificate and had have his aunt in Ecuador get a new one...she sent it in the mail but it still hasn't arrived yet. We have copies of the old one. I'm going crazy, I can't believe this is happening!


I hate to say this but yes he had to show the original birth certificate also had to provide a photocopy and a translation of it ..it is one of the required documents...on the other hand I wouldn t worry about it so much, the worst that could happen is them holding the visa till they get the original.

helpsmilie.gif Okay, One more big question. I have spent about 2 weeks and many tear filled hours in search of a "money order" or "C.O.D." to send and pay for my I-130. This does occur in Italy, but having a bank issue it in U.S. currancy is impossible. The soonest it "may" be available is in over a week. Well, this is a problem, because the fee increase is in affect in one week. I really don't know how i'll do to travel all the way to Rome. Does anyone have any ideas on how else I may make this payment to Rome via mail? I have gone to my local embassy and every post office and bank in Florence ( at least it seems).

cool.gif Next question: After I send out the I-130, I am trying to get a head start on my packet 3. Doese anyone have a current list of exactly what forms I will need and where to download them. This has been tricky. I have found a few here and there, but not all.

Sorry to be so needy all. But, right when I think things are getting easier they twist the other direction. I won't let the "man" beat me!!! But, he may get a few of my tears. I know a little mellodramatic, but this entire process is!!!!

Okay, I thought I had this clear but as I get close to actually filing, I'm getting confused again and can't find the posts I've seen before that already answered my question wacko.gif

First question:
Doing DCF in Italy, I understood that my address on the I-130 should be my Italian residence, as that's what qualifies me for going the DCF route. Just got momentarily confused as to whether this applies to the G-325 as well. That bio info form gets sent in with the I-130, so it should have the Italian address, right? Even though when we get to the I-864 stage, I'll use my US domicile address.... Do I have this right?

Second question:
The Rome embassy's website has a checklist for filing the I-130 (the DCF way). That checklist says specifically about the G-325A, "Please complete only one form for you and one form for your spouse. Do not submit multiple copies." But if you go to the link for the G-325A form, it's got multiple copies built in. Do they just want the first page? Just the info one time, signed one time? Or do they want the 4-page repetitive form as provided in the download (i.e., 4 identical pages) and required by folks who apply in the US? It all seemed very simple until I actually started it. It seems to me I should just fill out and print ONE PAGE in order to follow their instructions, but I don't want them to delay things asking me for the other 4 identical pages. Breezy, I think you may be the only person who can answer this for me. Thanks.

Sorry I didn't see your post sooner. I'm glad to hear your progress, and yes it seems simple until you sit down and actually do it. I dont know how many practice runs i did until i felt confident with my answers. Keep in mind that those forms are used for all kinds of visas, not only for spouses, (children and relatives) so they can be confusing, i know, you'll be fine.

star_smile.gif I went and double checked my forms, and I used my Italian address on all. Once i think it asked for U.S. domicile address, so only there did I put my U.S. address, on all others I put my Italian address. I did that becausue I've been living in Italy for 5 years now, and in the last year I've taken steps to "re-establish domicile in the U.S. and I included all that info seperatley for the I864 docs, in case they wanted to see my U.S. ties, which they didnt ask for. I also wanted to put my Italian address because I wanted no confusion as to where to mail documents from the Embassy. I called once and asked, and they pointed out that the petitioners address was requested more for mailing purposes.

So on every form I put my Italian address.

star_smile.gif We have a bank account at monte dei paschi di sena, we went to a main branch (sede in italian) and asked for a "assegno piazzato" a favore U.S. Embassy Rome, in U.S. Dollars. The I-130 packet was clear that it should be payable to a U.S. bank and already in U.S. dollars. We got it one the same day if I'm not mistaken, I don't remember waiting a week. The check was payable to the American Express Bank LTD. of New York. Have you called the Embassy, and asked them if there is an alternate means of payment? Ask if you can send a western union money order or if they have any other suggestions.

What is the fee increasing to? If it's soo much, will you consider going to Rome? In my opinion there is an advantage in paying in person, it seems, seems, that compared to another person who started the filing process who personally delivered the I-130 and mine, which I mailed, well they had a faster I-130 approval date. It could have been because that person didnt file during the Adam Walsh Act mess and I filed right at the begingin of the confusion, but I called many times and mine was just jumping from room to room, waiting to get on the right desk. So there might be that advantage if it is possible for you to file in Rome personally.

you'll need the DS-230 part 1 and 2, youll fax part one to the Consulate when they get your I-130 approval info from Rome. but youll keep part two and sign part to at the interview with the consular officer.

youll need I-864 for you and one for you joint sponsor if your using one.

the consulate later, super later sent me these forms which even are expired! So i filled out both just in case, and gave them the ones that I downloaded from uscis.gov

No, the B.C. hasn't come but we're still hoping that it will come tomorrow. Do you think the consulate will just hold the visa until they get the B.C. or will they reject our petition (hopefully it's the former!)

Kelvin had his medical today. He didn't really have a problem getting to Istituto varelli. He's staying at B&B Areamare (which he DOES NOT recommend, no hot water, dirty room, etc. At least the bathroom was clean he said.) He had to get one shot and it was E50. He made a friend at the hotel who is doing the same thing but his wife isn't USC, she's a permanent resident, so they have been helping each other out. He thinks that the people he has come across have seemed a little ignorant (for example, the owner of the B&B thought he was Japanese - he's South American). He also said that people aren't dressed very well compared to Rome, so he's sticking out. I'm a little worried about him getting mugged, he said some guy was trying to corner him.

So, tomorrow is the BIG day and I'm so nervous. I haven't been sleeping and have been forgetting to eat! Imagine me forgetting to EAT!
I can't believe we've come all this way only to lose the Birth Certificate at the last minute.

If you or anyone else in this forum has any words of encouragement I would greatly appreciate them.

I don't think that they will deny the petition and put you back to square one. He might get some kind of pending letter, maybe they will look at the other documents, and tell him as soon as he has the BC to come back. The people at the Consulate really were polite and patient, don't be scared, u 2 don't worry too much, it will work it's self out, you'll see!

I was coming to terms with the fact that I wouldn't make the June 30 deadline and I'd have to pay a E150 penalty to change flights.
On the way home, he hears from his brother that the mailman left a slip to come pick the b.c. up...it was too late, the post office had already closed at 1pm.
Now, he wants to get to the P.O. first thing tomorrow at 8:30am, get it, catch a 9:25 train that brings him to Naples Centrale at 10:52. The lady in the visa office (the first time I called) said he could arrive no later than 11:00...now, I'm not very familiar with Naples but I'm pretty sure that this is next to impossible. I called again to verify this, explaining the situation, and talked to visa lady #2, who looked into how many petitions they will have tomorrow and what time she thinks the Consul will go home. She advised me to give it a shot, that she thinks he'll still be around.

What should we do?

The risk is paying money for cabs and train tickets if they don't let him in, but we could also save a lot of money if they do!

What would you do??

I would go! But I think I missed something. Is the question whether he should go tomorrow or the next day? Can't he wait one day? Or is the consulate closed on Thurs and Fri? I guess if he's willing to try, I would try. Sure, you may waste some money, but won't it be exciting if he makes it? Best of luck in whatever you choose to do.

so, i wanted to give everyone a little update on Kelvin's visa situation.

He headed down to Naples on Sunday night and stayed at a B&B. He woke up early and went to the medical, which was no problem at all. The next morning, Tuesday, was the visa interview at the American Consulate. The Consular officer asked him questions like, do you speak English (he answered no), how then do you communicate with your wife (she speaks Italian), when were you married, etc and carefully inspected the photos we provided as evidence. Everything was in place, except his missing Birth Certificate, which he lost a couple weeks before the interview. We had gotten in contact with his aunt in Ecuador so she would send another, but it hadn't arrived before he left for Naples. We were hoping for a miracle. As expected, though, his petition was approved, but the visa wouldn't be granted until he presented his original birth certificate.

We got on a train out of Naples to return home. We were disappointed because we had booked a plane ticket for Saturday, but since the visa section of the Consulate is only open on Tuesday and Wednesday, we'd have to rebook the flight, pay a penalty, etc., and wouldn't get him to the states in time to beat the price increase for his Adjustment of Status, which happens on July 30. Oh well.

On the train ride home, he hears from his brother...the mailman came to drop off the Birth Certificate, but since he wasn't there to sign for it, he'd have to pick it up at the post office. The post office in Italy closes at 1pm and he was still on the train.

We decided that he would go to the Post Office first thing on Wednesday morning to get the B.C., take the next train to Naples, arriving at 10:52. The cut off time for the Visa section is 11:00. Cutting it very close. It's funny to think that after a year of waiting, it all boiled down to minutes and seconds.
But, he made it in time.

And yet he doesn't have a visa. What happened, you ask?
First some background: The Ecuadorian government doesn't know what year Kelvin was born because a long time ago there was a system crash and some data was lost. They think it's either 1980 or 1981. The lost birth certificate said 1980, and so does his passport and all the documents we filled out. Well, the birth certificate sent by his aunt said 1981, so the Consulate wouldn't grant him the visa yet.

We have to order another birth certificate from Ecuador, have it sent, and Kelvin has to go back down to Naples.
AHHHH!!!! What we do for love!

What a mess! I'm so sorry. I guess you'll have to wait a bit longer still. You seem to be in relatively good spirits, though. I guess it's a case of surrendering to a situation that's beyond your control. Well, I hope you'll be able to straighten out this BC confusion soon. Maybe it would help if Kelvin sent the copy of the previous birth certificate with his request for a new one, stating that it should be identical. What an unexpectedly strange situation this is!
