Hello everybody,

I have a couple of questions and I need your help please helpsmilie.gif

Our I-130 was approved on 08-21-2006 (the I-129F was approved in the same day, too, and it was forwarded to Casablanca)

I (the alien) received the « Choice of Agent form » - i sent it back and chose my husband who lives in USA as my agent.

We are following the NVC chart, but we are a bit confused wacko.gif … Sometimes, we wonder if we are going in the « right » track or not?!! blink.gif

Now we are less than a week to my I-129F interview in Casablanca (October 19th) … If everything goes well with my interview, I’ll travel to USA by December

For my husband’s side, he sent back the AOS Bill payment. He received also the I-184 affidavit of support package and he’ll send it back in the next couple of days!!

What should the next step be? Should my husband continue following the petitioner track as it is explained at the NVC Process Flowchart??

Or should we abandon and wait till my arrival to USA to start the Adjustment of status process?

We need your help because we are a bit confused and we don’t know what we should do???

Many Thanks for all

Najia,

What you should do is whichever you want to do.
- If you want to adjust status rather than go back to your country for an immigrant visa interview, apply to adjust status after you arrive in the USA.
- If you want to go back to your country for an immigrant visa interview rather than apply to adjust status, then do that. It seems that your husband has paid the fees already.

Thanks Yodark for your usual quick answer.

Yes, my husband paid the AOS Bill and he received the I-864 package.

do you mean, that if we want to choose the above option, we shouldn't pay the I-864 and WAIT till i arrive to USA and start the adjustment of status?!!

i.e We continue with the papers as it is explained in the NVC chart... ok, so how long this option takes? from NVC till interview at the embassy?? ... just an idea!!

Morocco is not always the easiest to get through. One interview passed successfully may be enough. You can read more in the morocco threads which you can find in the Regional Forums section of VJ. As Yodrak says though, it is up to you as to which path you travel to gain immigrant status. 1) Adjust in US from the K-3 2) Return for the CR-1 interview. They both grant the same thing.

ok, let's assume that we'll do the adjustment in USA... should my husband continue the NVC chart (payment of bills & I-864) EVEN before my arrival?? or should he wait till i'll be there?? i.e won't we pay the same thing twice in the first choice??

Najia,

Yes, that's what I mean. At some point you will also have to notify the NVC that you no longer wish to apply for the immigrant visa and will instead apply to adjust status.

Any fees paid are not transferrable so they would need to be paid again in the US for adjustment of status. You can hold off on paying anything further until after the interview. Once your interview is successful you can notify the NVC that you will be adjusting status in the US on a K-3. They will then send the approved I-130 back to USCIS for your adjustment of status process.
