I am confused! I married my wife abroad in the Philippines. When I read the instructions for the I-129F it states that if I am filing for my "fiancee" to send forms and payment to Nebraska because I live in Oregon. But, if I am filing for my spouse "nonimmigrant" to send it to Chicago. Now, it doesn't mention where to send it if it is for a spouse "Immigrant". So, where do I send the I-129F petition? wacko.gif I received my NOA1 from my I-130, and I am ready to senf the I-129F. Any help would be appreciated!

Chicago. The K3 is a non-immigrant visa, the CR-1 is an immigrant visa. smile.gif

On December 21, 2000 the Legal Immigration and Family Equity Act (LIFE Act) was signed into law. One of the provisions this legislation is the creation of K3 and K4 non-immigrant visas for spouses of US Citizens who are outside the US, and the children of those foreign spouses. These visas were created to allow reunification of families of US Citizens, by allowing the spouse and children to enter the United States as non-immigrants, and filing for Adjustment of Status inside the United States, rather than waiting for Consular immigrant visa processing.

The K3 is a derivative of the K-1 visa and as such is using the same I-129F form to allow the spouse to enter the USA as a non-immigrant in order to wait out the adjustment of status process, like a fiance would on a K-1 visa. This why you are using the I-192F form.
