Hi, applicant from London, with an approved I-129 on Sept 28. However USCIS status says the case was last updated on Oct 2 (Which I am assuming is the date it was sent to the NVC). My wife is with me in the UK and wants to quit her job in the UK before we move back to the US. Will this affect her status as a sponsor on the affidavit of support. (I134). I have a job offer in the US which should take care of our living once we get there and EAD is filed.

Can someone please advise on the exposure of this situation. Thanks !

k3takingtoolong,

Your wife quiting her job in the UK will probably not affect her ability to sponsor you, unless the job she has now is one that could continue after she returns to the USA.

Your job offer could possibly allow you to do without a sponsor. See 9 FAM 40.41 (Public Charge) Notes, N4.6-2f. (But you and your future employer should not overlook the requirements of I-9.)

k3takingtoolong,

DoS web site or Google. I don't know if it's a legal reference, it's a State Department policy manual - the Foreign Affairs Manual.
