Hi all

I received the NOA2 for both the 1-130 and the 1-129F in the post together.The receipt date for the 1-130 is October 3 2006 and the receipt date for the 1-129F is October 4 2006. Does anyone know which visa will be processed? Will they forget the K3 now? If so, does the I-130 take longer to be processed from here on in? Any help would be appreciated. Confused.

both will be processed ....... both files have independent path at this stage.......so just go along with both the processing........and you can decide if you want to abandon the K-3 at a later stage if the I-130 is moving fast enough and thiers not much difference.......as along with the CR-1 you gets EAD card and dont have to wait for more that two months for that.... ok hope this helped ltl bit........and i suggest just search and read everythig you can find in this VJ forums......its great and helpful enough that we dont have to depend on any attorney if its not any complicated case...... rose.gif rose.gif

If you choose, both can continue to be processed, but from what I understand if they end up at the consulate at the same time the consulate will pursue the IR/CR1.

At this point the K3 will be at the NVC very briefly and then go to the consulate. It really depends on which consulate to determine the average wait once it gets there.

The I-130 will continue to be processed at the NVC, and this can take up to 6 months, or even longer - so it is entirely possible that you will get the K3 first.

If you do get the K3 first, you then have the choice of going back to the consulate when the I130 interview is scheduled OR dropping the I-130 altogether and staying in the U.S. and applying for AOS. Hope this helps smile.gif

May I ask when you file your I-129f?

Thanks for the helpful messages. I have updated my timeline. It took 97 days to get my NOA2 for the 1-129F. It should have been faster, because our lawyer (hired by my husband's company) forgot to send a photo of my husband, so that delayed the process by three weeks. We were very upset because we have an 8 month old baby and the delay meant 3 extra weeks my husband doesn't see his son. Anyway, least I have the approval now.
