Hello All,
I'm new so I apologize if this question has already been addressed.

My husband is Ecuadorian and lives in Italy, and I live in the US. I want him to come as soon as possible and a friend told me I could have him come over as a tourist and then adjust his status. This doesn't sound right to me...is it true?
Please help!

You can file for his adjustment in the US once he is in the US. Please consult a visa attorney if you have any complications.

If he tries to come in on a tourist visa with the intent to stay and adjust status he will be breaking the law. It has happened that people have come on tourist visas and decided once they were here that they weren't going to go back for whatever reason, and that is not inherently illegal, but then you would have to be concerned with overstaying.

So basically your options are K3 or IR/CR1. Hope this helps,

I was told by the immigration officer in Phoenix that we could be charged for fraud and denied the greencard if we had chosen to do Adjustment of Status on a tourist visa. I know a lot of people do it...but it is definetely a red flag!
