If he tries to come in on a tourist visa with the intent to stay and adjust status he will be breaking the law. It has happened that people have come on tourist visas and decided once they were here that they weren't going to go back for whatever reason, and that is not inherently illegal, but then you would have to be concerned with overstaying.
So basically your options are K3 or IR/CR1. Hope this helps,
