Hi, we need advices!!
My husband (US citizen) and I both live in Germany, we are doing DCF in Frankfurt and we are about to fax OF-169.
Both of us are currently working at a research insititute in Germany. My hushand's income for last thress years definately meet poverty guideline. We are planning to move to US in 6-7 months but we have not looked new job yet. I need to have green card first in order to apply a job and doing interview in US.

Questions are

1. Would my husband have problems with proving that he has a domicle in US? (We are using his parents' address in US as permanent address.)

2. Would it be better if we add his parents as sponsor since he has not applied for new job yet?

3. Should he get a job in US first??

Any advice will be helpful!!!!!

We're going through the process ourselves; I've lived in the UK for the last five years (I'm the USC).

I was told at our interview that my income in the UK doesn't count and neither does his. We qualified due to the equity in our home; we stand to make an 80-90,000 pound profit on the sale of the house which is almost double the asset requirement that, according to the fellow we interviewed with, is $80,000.

If you can't meet the requirements with your assets then you probably will need a co-sponsor.

As for domicile, we didn't have any problems. They never even asked. They know we have a house here in the UK that we'll be selling but they didn't ask what we were going to do once we got to the US.

gmkpark, you don't say enough to answer your questions.

1-domicile is a very individual determination. There are several links in the DCF Guide regarding domicile, and the instructions on the newest I-864 (uscis.gov) discusses it also. It is usually LESS of an issue than people think.
2-Maybe. Do you (both or either) own any assets? Are they enough?
3-Maybe. How hard would it be for him to get a job, or some solid offers? Are your jobs specialty enough that you will be in high demand in the US?

The financials are more a 'totality of circumstances' and your husband should start off by completing an I-864 and see what he thinks.
If the parents have no objection and you two don't mind having the help, a Joint Sponsor pretty much takes care of all your 'income' problems.

As you read stories from others, remember that each Consulate is different in determining 'domicile'. What is sufficient in one post may not be sufficient elsewhere.
