Full Version: Can I still submit K3 application (129F) now?

I hired one of those attorney/ form fillers to submit the I130 G325 for me. I got the NOA-1 but I just found out the 129F was never submitted. I am being asked to submit the AOS and the forms for the CR-1. Is it too late to submit the 129F now and request the K3? Thanks in advance.

That is correct. I am married and my wife is in China. According to that comparison in the above link, a CR-1 can be quicker than a K-3? Is that true? Thanks.

Probably no benefit to starting on the K3 path now. Unless for some reason you'd rather have your wife wait longer for a non-immigrant visa than proceed on to get an immigrant visa, in which case you can not respond to the requests for the immigrant visa materials and file an I-129f instead.

I'm wondering lately how much of it is more choosing the wrong lawyer for the case?

There are a lot of lawyers who seem to know little about the (fairly new, but not that new) K-3 process, for example.

I think people should take more care to hire a lawyer who actually does a lot of family-based work vs employment -based, or choose the right kind of specialist. Not all attorneys are created equal.

I take what people write at face value, even when it's plainly obvious that they don't have a clue what they're saying. That being said, I observe that Beerhunter told us, "I hired one of those attorney/ form fillers to submit the I130 G325 for me." Perhaps the attorney here did exactly what they were hired to do?

I agree that people need to exercise at least as much care in selecting - and using - an attorney as they do in selecting and using their toothpaste.

Nope. I specified a K3 visa from the get go. My take is they forgot to submit the 129F when it was time to. How much longer is the CR-1 process compared tot he K3?

According to the stats on this site, the CR1 route takes about 401 days between the time the consulate receives the paperwork to the date of the interview. Will submitting an I129F now delay the case beyond that date? The stats here suggests it only takes around 127 days for a K3 to be approved and visa issued.

At this point of my CR1 application, I have basically complete all I need to on this end. If I submit the I129F now, do I have to refile and resubmit filing fees once the spouse arrives here on a K3? Thanks in advance.

I know that there is a long time between approved petitions arriving at Guangzhau and an interview, didn't realize there was such a big discrepancy between the K and immigrant visas. I find it surprising given that both are handled by the IV unit. I've heard a lot of good things about a web site called CandleForLove for visa information at Guangzhau, you might want to look there for confirmation of your statistics.

If you've already paid the immigrant visa fees, it's a sunk cost. If you begin a K3, and it does come through faster, you either pay a roughly equivalent fee for adjustment of status or you pay for your wife to fly back to China when the immigrant visa interview happens.
