Full Version: Wife is permanent resident, how long to bring unmarried daughter under 21 from Thailand?

I filed a I130 back in January of this year on behalf of my wife. My wife is a permanent resident. She came from Thailand April 2005 on a k3 visa. Now we want to bring her 13 yr old daughter from Thailand. Does anybody have a reasonable idea of how long it will take? Thanks Pete

Pete, can you please clarify?

Your wife did not get here without already having an I-130 filed for her (in 2004/2005?).

You yourself might be able to petition for her daughter--have you looked into that?

You yourself might be able to petition for her daughter--have you looked into that?

My wife came here in Apr 05 on a k3, we waited around 10 months for her. This year in January I looked on how to get my stepdaughter here. My wife became a permanent resident in Nov 05, so I figured I had to file a I130 permanent resident applying for unmarried son or daughter under 21. I have no idea if I can sponsor my stepdaughter because there was no form for that.

Yes, there is. In fact it is the same form. Please go to uscis.gov and look in the How Do I section.
Under Children, you will find the immigration definition of 'child' and you should find that your step daughter is your immediate relative.

You will probably want to re-file, leave the old I-130, and pursue a fresh case for your step child.
Then, as Boiler says, the process will take aprox. the same time as it took for your wife's case.
