I have heard people mention a notorized tax return but on the instructions for the i-324 I don't see that is required just the affidavidit of support...

Can someone answer this for me before I take a leap off a building. My fiance does not make enough to cover myself and her children so I'm getting another sponsor to fill out the 1-134. Does his I-134 he fills out have to cover myself, her and her three children or just myself (the beneficiary) and anyone dependent on him in his household. Please I need help because this process is driving me insane.

My household size is 2. I am going by the 2007 poverty guidelines from the form I-864 and my annual income just barely surpasses the 125% poverty line of $17,112 - by about $2,000.

1. Should I be concerned about this? Will this raise any red flags?

2. If yes, is there any additional information I should supply with my I-134?

I do, of course, have a bank account, life insurance (through my employer), a 403b account, and a 529 account.

Any advice would be helpful and thanks, in advance.

does tax returns really has to be notarized,? aside from having a notarized Affidavit of Support (I-134)? what I understand is that the income you declared on your Aff of Support is the exact amount on the tax returns..
is this necessary? it's confusing, I just read this thread, and my interview will be two months from now.

I dont believe so. Most threads have said that a transcript of your tax return is ok. You can request these free from the IRS. Others have said that photo copies were accepted as well but my understanding is the transcript is your best option. You can download the form from the IRS website and then fax it in to the office for your area. Offices are listed on the application. You can also request the w2s on the same request. Good luck!

You will find that much of the government documentation is vague at best. Many folks have found that the different Embassy's require above and beyond what the standard forms say they do. My contact with the State Department lead me to understand that the Consul can decide to request or require what ever they wish. It is a judgement call and the more proof you have the better your chances without administrative review.

His household would be himself, his wife, any other dependents and you the beneficiary. It would not cover her and her children. Hope that helps. Look to the guidelines posted for the I-864 and that will help I am sure. Those are the instructions used to calculate the poverty guidelines and household size. Good luck! good.gif

QUESTION 1:

Is the "INCOME" stated in the I-134 form "GROSS" or "NET" income???

because if i count my annual GROSS income.. i can exceed the poverty guideline
but if i count my NET income, i fall short of that guideline

QUESTION 2:

i am living in a house with my older brother, one cousin and one uncle.. all of them are independent and has work.
i plan on leaving to rent an apartment once my wife comes..

do i still count the people im living with right now under household size?? or should i not because i am clearly not supporting them??

I have a little question, I am looking at the I-134 form and I am going to tell my manager to get a letter ready, but the only thing I am worried about is the fact that I am a contractor or temporary and it wants you to list specifically if you are permanent or temporary, do you think this will hurt me?

Ok let me give you a brief background on this....I worked for this company that I am currently working at for 5 years, but I left to go and be with my fiancée in the Bahamas for 2 months then I came back the USA to get sworn in to become a citizen in January and I stayed in the USA. So when I tried to come back into my job there was nothing available permanent so I went to a Temp agency that ironically had a position with the company I worked with before I left but it was a temporary position. Now I hope that gives you a better idea.... helpsmilie.gif !!!

I've posted about my financial situation already on this board and have decided to go ahead and ask my parents to co-sponsor. The only question they have is that everything they have is joint account or applied. Taxes, bank, etc. Do they still need to each fill out an I-134 or can my father the primary applicant for their taxes and bank accounts fill out a form on his own that would represent the both of them? I couldn't come up with a definative answer for them. I'm guessing that the government being as picky as they are would still require each of them to file.

I just read this thread and we are hoping to get the answers of our questions about Affidavit of Support or I-134

Before my fiance filed k1 visa he was still working and at the same time studying (graduating student). It so happened that there was a conflict between school and work and he need to opt between the two. Since he is a graduating student he opted school than work. July of this year he graduated and at the same time lost his job and as of the moment he is working in a pizza place but not regular employee so we considered that he is unemployed right now. Regarding I-134, how can my fiance send me certificate of employee and stating his salary if he doesn't have any regular job right now?what are our option of providing affidavit of support?what shall we do?Can we use co-sponsor???please help us we are very much confused right now and I'm already schedule for medical and interview... crying.gif

I have a question, I'm currently in School and I recieve financial aid every semester, plus I work as an intern twice. Now with my financial aid, savings and my earnings that puts me above the 125%. How soud I state that my financial aid is my income? either way to be on the safe side I'm asking my mom to be the co-sponsor just in case.

So basically, my main question is: How would I show proof of my financial aid? does the school need to send me a special letter? thanks!

I was wondering if you found anything. My fiance is a college graduate and doens't have a job just yet and he is going to come and visit me here in germany for the next three months. If you found out what to do and what papers to file if the fiance doens't have a job, please let me know!!
We are still waiting on NOA 2, we filed in July and just want to get all the papers ready for the interview.

I have a couple questions:

I am having a co sponser.... What information will I need from him? His last 3 tax returns and a few pay stubs correct? Can he fax me copies since he lives in another state?

Also being as how I am not working I do NOT have tax returns. However, I was claimed as a dependent. I am to get a copy of that information right? Do I get a copy of only the page stating I was claimed as a dependent or the WHOLE tax information?

That was more than a couple questions I know. Heeheeeheee!

i got a (maybe dumb)question about the notary on form I-134. when i have this notorized, does the notary just stamp, sign & date anywhere on the bottom of form. i'm fairly sure the "subcribed & sworn...signature of officer administering oath" part is for a immigration official. unsure.gif

How often do the co sponsors actually work? I've recently started a new trade where I do lots of short jobs over the year, but as I only started half way through last year I don't have the required income myself (but I'm only three thousand short by myself). Before that I wasn't working by my own choice for a year or so. I have both of my parents and a friend willing to cosponsor: my mom makes just a touch more than I do, but her work is steady; my dad makes around three times the requirements (for the appropriate household size), but isn't working right now, as he's in the same trade as me, and our work is sporadic but well paying; my friend makes just a bit more than required. Will this be enough to get the visa approved? Also, my parents don't have tax returns for the past years as a result of not having paid taxes yet (a situation they're working to remedy but likely can't before the interview), so what other evidence could be provided? This is all for the Sydney consulate, if that makes any difference.

Also, is there another place that's better to post this?

The notary will sign and stamp in a couple of places actualy....but only after he/she has checked the entire document for completeness and no missed spaces (put NA wherever needed) and you have to raise you hand and swear that the whole document is correct. good.gif

My fiancé is currently filling the I-134 and he's wondering about the expiration date. He's downloaded the only I-134 on the USCIS website and its expiration date is 04-30-07
he's called the USCIS about it and they say it's ok
We just want some extra confirmation that we're making everything right

Are K1 visa holders allowed to get financial aid in college? My friend, who came on a K1 visa gets financial aid, and I hope my fiancée will be able to get financial aid. But I don't not want to get a bill in the mail from the government years down the road.

What are My Responsibilities as a Sponsor?
When you sign the Affidavit of Support, you accept legal responsibility for financially supporting the sponsored immigrant(s) until they become U.S. citizens or can be credited with 40 quarters of work. Any joint sponsors or household members whose income is used to meet the minimum income requirements are also legally responsible for financially supporting the sponsored immigrant. If the immigrant receives any "means-tested public benefits," you are responsible for repaying the cost of those benefits to the agency that provided them. If you do not repay the debt, the agency can sue you in court to get the money owed. When in doubt, ask the benefit provider whether the benefit is a "means-tested public benefit."

Currently, Federal means-tested public benefits include Food Stamps, Medicaid, Supplemental Security Income (SSI), Temporary Assistance for Needy Families (TANF), and the State Child Health Insurance Program (CHIP). States and local jurisdictions may also designate certain of their programs as means-tested public benefits.

The following types of programsare not counted as means-tested public benefits: emergency Medicaid; short-term, non-cash emergency relief; services provided under the National School Lunch and Child Nutrition Acts; immunizations and testing and treatment for communicable diseases; student assistance under the Higher Education Act and the Public Health Service Act; certain forms of foster-care or adoption assistance under the Social Security Act; Head Start programs; means-tested programs under the Elementary and Secondary Education Act; and Job Training Partnership Act programs.

Do you have to include all the 1099-INT's, 1098-E, and other statements you used to get credit on your return, or just the actual 1040 form? Do you include a state income tax return or federal only?

My fiance sent the I-134 with NO answer on section 11 since he thought he would not know the exact number of his particular contribution to me. Pls answer

Hi, I'm a USC just starting DCF CR-1/IR-1 in Australia for my wife who is a New Zealand Citizen.. I have been in Australia with my wife since February of 2007 but did not start working until September of 07 (Visa took a while)and I am still employed at the same place now....I was not employed in the states for any part of 2007. I have a few questions... Do I have to file a tax return with the IRS for the time I was employed in Australia last year? Do I have to pay taxes in both countries for the same income? Since I wont be filing the I-134 until after April 15, will I need a tax return for income from last year? How many past tax returns will I be needing? If I file the I-130 petition before April 15 will I not be required to show a tax return for income from 2007? Also, I had closed my bank account in the states about 8 months ago, will that be a problem for us? We've had a bank account here in Australia for a year though and we have a joint sponsor in the states that will be able to satisfy the financial obligations, will that be enough?

I was also wondering about providing copies of my previous tax returns (how many years) and copies of pay stubs, etc.? The I-134 form doesn't specifically ask for these - so it is just additional info that is recommended? What advice on this?

(The provisions of the above laws are contained in form DS-1858, Sponsor's Financial Responsibility Under the Social Security Act, and printed in Part III of the instructions for Form I-134).
The sponsor should include in the affidavit a statement concerning his or her status in the United States. If the sponsor is an American citizen the affidavit should include a statement about how United States citizenship was acquired. If naturalized, the affidavit should indicate the date of naturalization, the name and location of the court, and the number of the sponsor's certificate of naturalization. If the sponsor is an alien who has been lawfully admitted into the United States for permanent residence, he or she should state in the affidavit the date and place of admission for permanent residence and the alien registration number which appears on his or her Alien Registration Receipt Card.

To substantiate the information regarding income and resources the sponsor should attach two or more of the following items to the affidavit:
  1. Notarized copies of his or her latest federal income tax return;
  2. A statement from his or her employer showing salary and the length and permanency of employment;
  3. A statement from an officer of a bank regarding his or her account, the date the account was opened, and the present balance;
  4. Any other evidence adequate to establish financial ability to carry out his or her undertaking toward the applicant for what might be an indefinite period of time.
If the sponsor is well established in business, he or she may submit a rating from a recognized business rating organization in lieu of the foregoing. If the sponsor is married, the affidavit should be signed jointly by both husband and wife. Affidavits of support should be of recent date when presented to the consular officer. They are unacceptable if more than one year has elapsed from the date of execution. A sponsor may prefer to forward his or her affidavit of support directly to the consular office where the visa application will be made, in which event the contents will not be divulged to the applicant.

Instructions for the I-134

Execution of Affadavit
A seperate affidavit must be submitted for each person. You, as the sponsor, must sign the affidavit in your full, true and correct name and affirm or make it under oath. If you are in the United States, the affidavit may be sworn to or affirmed before an immigration officer without the payment of fee, or before a notary public or other officer authorized to administer oaths for general purposes, in which case the offical seal or certificate of authority to administer oaths must be affixed.
If you are outside the United States the affidavit must be sworn to or affirmed before a United States consular or immigration officer.

Supporting evidence
The sponsor must submit, in duplicate, evidence of income and resources, as appropriate.

A. Statement from an officer of the bank or other financial institution in which you have deposits giving the following details regarding your account:
  1. date account opened
  2. total amount deposited for the past year
  3. present balance
B. Statement of your employer on business stationery, showing:
  1. date and nature of employment
  2. salary paid
  3. whether position is temporary or permanent
C. If self-employed:
  1. copy of last income tax return filed, or
  2. report of commercial rating concern
D. List containing serial numbers and denominations of bonds and name of record owner(s).




Hey everyone. We will be scheduling an interview in Tokyo soon. It looks like sometime in July. The documentation required for the I-134 includes Transcripts of the last Tax return filed. My last Tax return filed is 2006 (self-employed). I plan on including a copy of my 2007 Extension with the 2006 Transcripts. If were able to file my 2007 tax return now.... it looks like I might not get the transcripts back in time before I go and join my girl in Nagoya. So the question is should I just include the last return filed "2006" and my extension for 2007.

Howdy VJ'ers-

I have reviewed about all the FAQ's and Guides posted online at VJ and elsewhere, but still have a few questions I'd love to get some takes on.

#1 - Are just the most recent year's tax returns needed, or do I need to send copies of the last 3 years?

#2 - (Question 7 on the I-134 Form) Is it necessary to list estimated "personal property" if you feel your income/ other assets are sufficient to answer the question? If so, how much supporting documentation, if any, should be provided?

#3 - (Question 7 on the I-134 Form) Is it necessary to list all one's stocks/mutual funds/annuities, or can just one account be listed and documented if that appears sufficient to answer the question of ability to support the person being petitioned? (Prefer not to give out all that detail if it can be helped).

#4 - (Question 7 on the I-134 Form) Is it necessary to show a recent appraisal of one's real estate to support the quoted value?

#5 - (Question 8) If you did not list your fiancee/petition beneficiary on your last tax return, this should be left blank, correct?)

#6 - (Question 10) This question does not apply to the person being petitioned on behalf of - it means someone else (previous fiancee, children, etc. Correct?)

#7 - (Question 11) The sample form n VJ lists the appropriate response as " N/A (K1 Visa Process for Permanent Residence)" Just want to confirm this is what they are looking for.

#8 - (II - Instructions) - Is it true that 2 of the 4 listed methods of "evidence of income and resources" is considered sufficient for approval, if the income/asset guidelines are met?

I think this covers it...if anyone wants to point me to any additional posts, please feel free. These are the ones I have reviewed at VJ thus far:

Don't sign it until you are in front of the notary. He/She will know exactly how to fill it out. The county is a place for him to fill in. Remember DON'T SIGN IT UNTIL YOU ARE IN FRONT OF THE NOTARY. star_smile.gif

Hello everyone, i have a question about the co-sponsor requirements for the I-134 Affidavit of support.

Currently im a student and working part time so i dont earn enough to sponsor my fiancé by myself, so it looks like the only way for me to be with her is to get a co sponsor. My sister volunteered to be my co sponsor however there might be a problem. Until recently she was unemployed as she had just finished her masters so her past couple years of income tax was way below poverty line for a household of 3 (her my fiancé and i). Luckily for her she recently got a job with a company and will be earning more than enough for her to be a cosponsor for my fiance and i however the job doesnt begin until Sept 22 which remarkably is the same day my fiance has her interview at the Tokyo embassy.

Im concerned that even though she now earns enough to cosponsor us, the fact that she has yet to start the job and her past years income tax might not qualify her to be our co sponsor.

If anyone has any thoughts or information on this it would be greatly appreciated.
