Hey everybody,

I guess I already know the answer to this one, but I'm just gonna be sure by asking the advice of the well-versed VJ members... tongue.gif

I came in to the US on the K1 fiance visa and got the temp EAD at JFK.....

Well I knew that after 90 days I would have to stop work with this temp. work authorisation. Recently I have been talking to a few people who said they had heard of other people who managed to "extend" their work visa until they received their 1 year EAD. I tried to explain to these people that this probably wasn't the case with my situation, but I said I would check on this forum just to be sure......

it's a shame aswell, I've got a nice position at an Italian restaurant in town, the boss is great (I feel pretty guilty having to tell him tomorrow that I can't work for him anymore), and we get great Italian meals to take home!!! yummy!!

However, I am certainly not gonna work if it's not allowed (Italian meals or not!).........

You're right Paul. Once your 90 days are up they are up and you need to wait for the one year EAD to arrive.

Hey, maybe they'll let you come back to the restaurant after you get the card?

Have you submitted your AOS package yet, complete with the I-765 application? Have you received a NOA for the EAD submission?

Looking at his signature I would say yes he has filed.....

Adjustment of Status

CIS Office : Sacramento CA
Date Filed : 26th of July, 2006
NOA Date : 4th of August (for both I-485 & I-765)
17th of Aug: RFE sent by USCIS for I-485
18th of Aug: Biometrics appointment in Sacramento
19th of Aug: touched (I-485)
21st of Aug: touched (I-485 & I-765)
24th of Aug: received RFE


Sorry to hear you have not got your 1 year EAD yet....

I thought the temporary work authorization that you get at JFK is ONLY VALID UNTIL MARRIAGE (which is in the longest case up to 90 days) and after that you would have to apply for the reg. EAD?

The temp EAD is valid until the date on the I-94... 90 days. it does not expire when you marry....

A lot of employers have the attitude that it's not their job to enforce the immigration laws. I can't say as I disagree with them. If you keep working for your employer and he keeps taking money out of your paycheck for FICA and income taxes and sending it in to the government under your SSN do you think they are going to tell him you aren't authorized to work? They don't even complain if it's a completely bogus SSN, let alone one that's not authorized to work. So if the government doesn't take it serious, why should your employer?

My wife got several job offers while she was waiting for her greencard. She told them she didn't have an EAD and they said they didn't care as long as she had an SSN and a driver's license.

My son had an EAD when he got his job but he said they never even looked at it. He had an SSN and a driver's license both issued by the government so I guess his employer figured that was good enough. I even got him a second EAD at the cost of another $175 because our petition was taking so long. Nobody ever looked at that one either.

Obviously you don't want to jeapordize your AOS petition by breaking the law and we didn't but I'd say the odds of anything happening are pretty slim. I've never heard of it. Has anyone else?

If it was ok to work with out a valid EAD then why oh why do we all have to apply for one.....

When I was asked at my interview if I had done any work prior to getting my EAD I was able to say truthfully that I did not.....

I would never encourage anyone to do anything that could have a bad effect on their visa journey.... not a good idea.

Its the employers obligation to apply the law in terms of hiring immigrants. As such its up to them to figure out if you're legal to work or not, not you. As such I personally would continue to work unless my employers told me I couldn't.

Unfortunately for me, my employers are fully aware they can't employ me after the end of the month. sad.gif
