Hi, can anyone help me, I just need to know about the Afidavit of Support i'm filing for my husband, when should i file it? I just received the approval NOA2 this August6...Should i file it before his upcoming interview of he just needs to show it during the interview? Will there be a problem if i'm just starting to work right , I won't be able to file tax returns because I just finished college this May. I will just start work this month.. Is the interview subjected to denial if I just started working right now?...Is it okey if I have co-sponsors to file the Affidavit of support to make sure?Could he answer the interview by saying that we are both engineers and will be making a reasonable salary..??

Your approved petition should be received by the NVC shortly if it's not already there. You should read the Time Savers thread in the National Visa Forum to see what the process is like for CR1/IR1 visas, especially pages 1, 10 & 11.

In a nutshell, you won't need to file the AOS (I-864) until after you've paid the AOS fee bill. This probably won't happen for another few weeks or so. You will need to submit copies of pay stubs & letter of employer. Since you're just starting to work you will need a co-sponsor.

All of this happens before the case is forwarded to the embassy for the interview.

Hi there. I was reading the CR1/IR1 guideline and it states that

"Also, if your relative is your wife or husband and you have been married for less then 2 years at the time of his/her arrival at a port of entry, then he/she will receive a temporary I-551 Stamp and then later a Green Card by mail good for only 2 years. Ninety days before the green card expires you will have to file an I-751 form to remove it's conditional status."

When we were married we knew each other less than two years so were under the CR1 status. My husband had his interview in June 2008 in Cairo and now we are waiting for the name check (we assume since it's all called AP) for him to get his visa. Should the embassy automatically change that to an IR1 since we've now been married over 2 years and he still isn't here or will we have to do that at the POE?

Also, does anyone know if JFK is the only POE that he can get his work permit through?

Yes, he can call the embassy to see if they need to do anything in regards to his IR1 visa, since he should be eligible for it, instead of the CR1. If not, then he can straighten it at POE.

Also, since he's coming in with either a CR1 or IR1 visa, he won't be given an EAD stamp. Only K1 visa holders are eligible to get this stamp. But since he'll be getting his green card by mail a few weeks after he enters the US, he should be able to work as soon as he receives it.

Hi,
I sent my DS-230 form on 10/1 via priority mail with signature confirmation. I looked the status online at USPS and it says that they tried to deliver it today and not able to so a notice was left. Has this happened to anyone else? Do they attempt to deliver again? unsure.gif

No, she doesn't have to stay in Egypt to show that the marriage is genuine. She would have to stay in Egypt for 6 months if you were applying for DCF. But for a CR1 visa, she can get married and leave the next day as long as you have enough proof to show that you have had and still have a legit relationship.

Hi, i had a question we filed for the I-130 then I-129F for K-3 and its approved but the petition was denied do you think we can still appeal to used the IR1/CR1 even the K-3 was denied? because the decision was we cant proved that our marriage was bonafide only for immigration purposes only, but of course not! do you think using my maiden name on the petition and forgot to report our marriage at the Phil. Consulate is the main reason why i got denied? i got my refusal formaly last Sept 29, 2008, please anybody knows how? help me.....

I have a question,..I just recently graduated June 2008 and I have to file form I-864 for Affidavit of support form my husband..I just recently started a part-time work and will start my 2nd job next week as full time..I have 3 co-sponsors along with their incometax return forms copies..is this ok if I can't show any incometax return yet?? I got a letter from my employer stating that I got the job for full-time,and I got my 1st paycheck from my part-time job. I am sending xerox copies of these..Is this enough?I really can't show anything about tax return yet>>>

Hello, I have some few question about this process to see if I can still do it,

On June 22, 2007, my I130 IMMIGRANT PETITION FOR RELATIVE was approved and On September 5, 2007, I129F approved PETITION FIANCEE, so on december 2007 I come to Miami USA and lived my husband and We have stay together here until today, but now He has a job proposal and He has to move overseas Spain what will be a really good move for his career, however unfornutly for many circunstances with the most important the economic impact here since january 2008 until this month we couldnt do the AOS for all this economical recession and my husband couldnt save enough that is why He was looking fordward to get a better job or get promoved with the company he actually works as enginneer.

But Now If He leave and We apply now to AOS , I should stay in the USA without my husband until He can get me to Spain, or could I still Apply for the I130 IR1 going back to my country..? and wait there for a second interview and of that way I get the residency ..or I should stay in Usa and continue with the AOS...in my case what should I do best?

Regardless of what you decide to do, once you get your permanent residency, you are not supposed to live any other place other than the US. Thus the name permanent residency. If you move to Spain with your husband to live there, you will lose it.

I think if you want to move to Spain, the best thing would be not to file for AOS and move there with him. As soon as you decide to move back to the US, if that's in your plans, then you will have to start the immigration process from scratch and file either for a IR1 or K3 visa.

hello all, i was wondering. whats the average time frame for the CR-1? do you have to file for the K-3.

You file one or the other but not for both. The time frame depends on how fast or slow your service center is processing petitions, how fast you can go through the NVC process and it also depends on the US embassy it is going to.

I ask this above because I kind of want to follow Jame's shortcuts but want to make sure the entire process is going to be the same first. Can I use Jame's shortcuts which reference CR 1 on a CR-2 for child??? Is the process the same??

Any takers on an answer??
