---> What is a K-3 Visa?

Often people are uncertain which visa they should use and if a K-3 Visa is correct for them. A good start is to understand what your visa options really are.

Once you file you will have several options available to track your case.

Hello I was wondering if anyone had interviewed at the American Embassy in Manila and if so if there were any tips I could pass along to my wife about the interview processes thanks for your time.

hey do you have any advice? im irish, my husband is american, we got married in ireland in may and applied for K3 visa. he is in the sates and im in Ireland and we are still waiting? is this the usual amount of time it takes to get approved? the i-130 got approved last week, but the K3 still has not. tis very frustrating as we were told time and time again the K3 is the quicker way and only takes 90 days?? im still in Ireland 8 months later!?

Okay, so I understand that if the IR1 gets approved first one can abondone the K3. But is it just as easy to disgregard the IR1 and continue with the K3/4 as it is the other way around?

Two weeks ago my wife's K3 was approved at the embassy, she has the visa and will be on her way here next week. We've now received word that the IR1 petition is at the embassy and they're ready to schedule an interview.

Anna's coming here on the K3 next week with non-refundable tickets, not to mention the children don't yet have I-130s on file (long story but the short of it is we were going to file their I-130s as soon as they got here then ask that all of them be processed together), so they can only come as part of Anna's K3 under K4 status.

The timeline for AOS etc is not my concern, getting my family (ALL of us) together again IS...

ASSEMBLY NOTE
for K3

I used the Assembly guidelines from VJ and it states the use of ACCO fasteners (I clicked the link in the info for filing I-129f for a K3 on the guides)

Might be something to post here, that I just noticed on the instructions from USCIS website for assembly for things going to the Lockbox (I129f goes there) they state:

Please refrain from using “ACCO” style fasteners and/or staples (However, it is ok to staple the fee to the top of the primary application package.)

too late for me, but if it says refrain, I'd refrain!!

It also states for certain cases. I really dont think its an issue with the I-129F for the K-3 with the general USCIS rules for filing sufficing.

The date reached is based on the data that each member puts into their timeline. As you are through NSC this is calculated using the data of all those going through NSC. It is only an estimate as not all members complete the info....hence one of the reasons you will often see timeline.gif It is also sometimes filled incorrectly.

I submite teh I-130 and them the I-129K for spouse could I also submit the DS 230, or does this process have to be done by my husband in his native country??? hwo do I submit teh DS 230???

If you are doing K-3 then the DS-230 is submitted by your husband with the interview. This is the application for a visa and alien registration. If you are doing CR-1 then the DS-230 will be submitted to the NVC when the I-130 processes through there.

I got married to my Ukrainian bride in the US last June (Through a K1 Visa) and she left me to return to the Ukraine on 11/05.

We have been talking as She wants to return to the US. She has a child from a previous marriage as well.

My Question:

Do I need to fill out ( 2 ) I-130's one for her and one for her daughter?

I guess I am going to start this process over again!!!!

I read your K3 guide. It says "keep ALL originals". Does this include the signed original I-130, G-325s, etc. I.e. I would only send copies of these forms? I think not-but figured I should get clarification.

On the bottom of the G-325A where it says: "[b]APPLICANT" "Be sure to put......name and alien registration..."

Do I enter my name on my form, my wife,her name on hers, even if alien registration doesn't apply-just enter "NONE" under registration#?

As long as the beneficiary and petitioner each sign their own, there is no problem with the other completing the form.
A USC will not have an alien registration number so put 'None'
The beneficiary will only have an alien registration number if had prior dealings with USCIS, otherwise they will be assigned one/many during the process, so can also put 'None' in this instance.

'Keep All Originals' means things such as birth certificates, marriages certificates etc....submission of photo copies is all that is required. All forms must be submitted in the original with original signatures.

The beneficiary is the applicant for their own form. The USC petitioner is the applicant for their own form. Each G-325A is made up of 4 pages.

Just one comment. I think, a naturalized USC does have an alien registration number, but a born citizen does not have one. As a naturalized US citizen, I do have an alien registration number.

My wife had her interview on 21 June. Basically dress like its for a job interview and be professional. Have all the information about you she can possibly have, dates and such, bring photos and copies of letters, just like your filing the G-325a all over again, she's going to want this if she has to look back. She should also just relax and not try to worry too much.

There should be a pre-inverview with a Filipina who will ask such questions as, where did you meet, does he have any children, has he ever been married, where do you(her) work, if she does have a job she might be asked how much of a discount there is which would be typical. If everything is in order there should really only be 2-3 questions asked. "How long have you been married?", "Where did you get married?"

Those were the only two questions my wife was asked. The acutal interview took all of 5 minutes with the pre-interview taking about 15.

Best bet for your wife would be to get to the embassy at least 90 minutes early and just wait around until they open the doors.

If all your paperwork is in order and nothing left to doubt it will only be a matter of days for her to get the visa.

You and your wife have nothing to worry at the interview. It is all personal questions and are easy to answer. Just be honest and tell the truth. Some questions they ask are like " how did you met?", " When and where did you met? " something like that. So nothing to worry about King cos she'll soon get her ok. Goodluck good.gif

Now, should we abandon the I-130 for now, since it seems to be taking over 400 days for the interview, and proceed only w the I-129? Would it make sense to pay the extra fees and do the paperwork for the I-130 at this point? Any help would be deeply appreciated.

Always best to post specific questions in the general forums.

Has the I-130 been through NVC where you have submitted the I-864 and DS-230 etc? or has it already been through NVC and is now at the consulate in Manila? If that is the case an I-130 will over-ride the I-129F for the K-3.

You might want to call them. You could wait up to 30 days for the NOA 1 so 12 days isn't that bad

Hi! You should be able to find out the estimated process time at the USCIS site if you have setup a portfolio on the site. If you haven't you might want too do so. Both my NOA1 & NOA2 each took 2 weeks+. You were suppose to send your I-129F to Missouri versus Chicago?? My K3 I-129F went to Chicago(Received NOA2) , who will then send our paperwork to Missouri, who will eventually send required paperwork too the Consulate.

We signed up at the USCIS site so we could track applications and for email nothifications. So far we have received 4 email notifications that I-130 was approved and I-129f is being processed.

This is sort of unrelated but I'm not very good at using this site. I'm filing an I-130 through the English consulate. If it's not approved, i'll go through a US office. I'll keep people posted on what happens with that. My question is about social security numbers and driver licenses. I guess if there is no VISA/greencard, I can't get a social security number for my husband. But I have been told by the dept. of motor vehicles that if there is no social security number, that he can get a form saying he is not yet eligible for one, and this document will suffice when applying for a drivers license. Does anyone know anything about this? If he is visiting the US, it is important to me to get him a license to drive. Thanks guys.

Since you are filing via the office in London, post in the Direct Consular Filing forum for more people doing what you are doing.
In the blue tabs at the top of the page, look for Guides, and then Direct Consular Filing. It will explain the Social Security number for you.
Your husband probably won't be eligible for a driver's licence until he moves over, but all DL rules are state-by-state. Most states are now complying with the Real ID Act and won't issue a license to a visitor.

I would like to add some information for those going through the K3 process regarding the medical.

When you have your medical done in your home country, please ask the Doctor for a copy of your medical record and the vaccinations done.

For your adjustment of status here in the States, your medical needs to be current ie within a year from your original medical date. Also many people do not have any vaccination records and cant get a hold of them thereby costing alot more to either retest or have new vaccinations given to comply with the I693a which is the supplement from the civil surgeon here in the US.

Also, many people who have had the full vaccinations done at/or before your K3 medical, and received a copy of both the medical records and vaccination supplement have submitted these with your I485 adjustment papers and not recieved an RFE... although some have recieved an RFE but with records of your vaccinations it is relatively easy to see a civil surgeon and have them copied onto the correct supplement record.

Note: Im pretty sure not all Doctors or countries will give you a copy but please ask. If the Doctor wont then when you have your interview.. ask the interviewing officer if you can have a record of your medical and vaccinations... cant hurt to ask and will be helpful when you get here...

Hello All, This is my first post so I hope I am doing it correctly. Here is my question. If married to a Filipina who has two young children. Do I file an I-130 for each of them to come to the States? And if yes do I also send fees for each one? And if I should file an I-130 for each do I copy all of the supporting documents three times and attach them to each I-130 or just give them one copy of the supporting documents but three I-130's? I am worried if I don't submit an I-130 for each one then I will have problems with the Adjustment of Status for the kids later. I will also file for a K-3/4 for them all as well once I figure out what to do about the I-130's. You probably have answered this many times but I just couldn't find the answers no matter how hard I searched.. Thank you all for any help you can give to me on this subject. Sam

I-134 Please make sure that when you get this form notarized as it has to be, that the notary stamps on this form! Don't let them say that they have to attach a paper to it with the stamp. I did this and it was the only thing that stopped the visa of being approved. They want the stamp on their form, give it to them that way. I went to the bank and they notary said she had to attach and that it didn't have the proper wording blah blah blah. If they say that leave and find another notary. Not only will it say time and heartache but also alot of money. As I had to pay close to $50 to send it to my husband so that he can have it in a few days. Just wanted to give a friendly word of advice as to say someone else the heartache I had to endure.

We are applying for both CR1 and K-3 in San Salvador.

WIth the CR1 we are at the last stage of just getting an interview date, but we keep calling and they keep saying they don't have the interview shedule, and to keep calling back.

Meanwhile...

Our K-3 is at the point where we need to pay $100 to the bank and call for an appointment for the interview.

In your opinion, should I go on with the K-3? if they don't have available interview times for the CR1 is it possible to get an interview for the K-3? Is it worth the $100 to try to get the K-3 at this point? or just wait for the CR1??

I am very much new to the site my I-130 got approved my wife is back home . now NVC has sent me I864. ok due to the low income i have my uncle is willing to support me I made about $13,000 last year . and my uncle made $17,000 but he did his tax returns with his wife she also made $11,000 . I am kinda confuse here which form should i fill out i know i864 for myself . what about my uncle should he fill out I864A or I864. also he never lived with me . helpsmilie.gif thanks

hello! anyone out there who can help us with our next move?
Last november my wife petioned me for a spousal visa. She submitted form I-130 but not the I-129 yet.
I also applied for a tourist visa last november which was granted.
Right now we are all in the US with our son who is an american citizen. What's our next step so I can stay in the US for good?

I just have a few questions about obtaining a K3 visa and I was wondering if anyone can help me...

My husband currently lives in the UK and we just filed all the paperwork to get him over here to the US (the I-130, I-485 etc) and according to all that I've read it can take anywhere from 3 months to 2 years to be approved. We are expecting our first child in May and I want him to be here for that and onwards.
Can he come as a visitor and stay before the paperwork is approved? He can stay for 3 months on his passport as a visitor, which wouldn't make him here illegally.
He is coming for a week long visit this month, and then plans on returning in early May after he has finished work and sold all of his belongings. Will he be red flagged and not allowed back in to see me or our child?
I am very worried that the more he travels back and forth, the harder it will be for him to get here when I need him most. If anyone can give me some words of wisdom, I would greatly appreciate it. Thank you!

Before I was married my wife had a 10 yr multi entry visitor visa. She came to the USA twice without any problem and stayed 3mo each time. On the third time 5/18/07 the boarder patrol denied her entry because she said she was traveling to visit her fiancee. She had a return ticket and had alway return within the time, never worked in USA and never received social services yet she was denied and they revolked her 10 yr visitor visa. I can not find in the law why she can not visit. The boarder patrol have their interpritaion and they have the power. I thought she could travel to USA on her visitor visa and I could travel to Thialand on visitor visa or retirement visa until we resolved our fears and differences then in our time get married and file K-3 method. Our time table was moved up and to resolve the issue I returned to Thailand we got married and I return to USA filed I130 and I129F. We are still waiting.

Hello, I want to marry my girlfriend in Colombia as soon as possible so that she can finally come live with me in the US. I was thinking about getting married by power just to speed up the process and because i can't travel anytime soon and i really need to be with her here.

I was reading the i-130 for realatives and under the instructions it says that i have to be phisically present at the time omf marriage, is there anyway around that or should i fill out a different form? Or is it easier to send in the i-129 for Fiance's?

Can somebody guide me with this? i really want to have her here as soon as possible. Thank you

It is much easier to send I-129F for fiance and certainly faster.

Do you mean marry via proxy??? If you mean that, DONT. You have to consumate the marriage before you file a I-130 and etc. and USCIS will ask for proof if you went to see her after proxy marriage. I think I submitted enough proof, but dont give them a reason to deny your petition. I married that way, we exhausted all efforts of marriage in Paris, we tried for 8 months. So we went the proxy way, and had our honeymoon,

Do what Jeca says, file the I-129F ficance petition.
