If you and your boyfriend live in your country for more than 6 months, then you can apply for visa directly through the consulate.Find out more on DCF forum.

My fiance and I have an approved I129F and were ready to go to our visa interview this month.
During the process, he told me he had married in Mexico a like 6 years ago and the divorce just went through. I updated all the papers with his former spouse and the divorce certificate but was wondering if this will be an automatic denial at the embassy since the I129F was approved witht the assumption he was never married.
If this is the case, how should we proceed. Withdraw and refile? Or Explain at the emabassy?
Please help!

Hi there! I look at your website and it seems you help a lot of people, my husband is an american and he was now at California while I am here in the Philippines waiting for my visa, we file our K3 visa and pass the 129F and the I-130 form, now we track our processing dates through looking USCIS, so what will be the next should I wait also a Packet instruction or aside from those papers I need some other documents to submit to them....
Please help me I am getting confused already!!
Thanks!

What is a K-3 Visa?
Often people are uncertain which visa they should use and if a K-3 Visa is correct for them. A good start is to understand what your
visa options really are.
K3 Guide or check out the
Guides Section for more helpful information on Spousal Visa's, as well as other visa types that apply depending on where you and your spouse currently reside.
Once you file you will have several
options available to track your case.

This visa option is automatically also is applying you for a IR1/CR1 visa (by filing the I-130). Historically the K-3 was used to allow the US Citizens spouse to enter the US faster than waiting for the I-130 to be approved (since that used to take a long time). Recent reductions in processing times have allowed I-130's to be approved quick enough that the IR1/CR1 visa process has been a quicker and better option for K-3 applicants. If this happens the K-3 applicant can abandon the K-3 route and persue the IR1/CR1 instead.

HELP...
my son 24, is here with me in the USA. he has been for the passed 3 = years.
My husband is from the USA, I'm from the UK and a LPR along with the rest of my kids, but my son timed out!
My son has been dating, they are planing to get married as they have a child, and we don't know which is the best way for him to go, should he wait out the go thought the immigration process with my husband and I,then get married or would it be best for them to go ahead and get married. Can he get a K3 while in the USA? he cost of the filing fees are a big factor in all of this. Any help would be great.

We are trying to do the K3 but we just read that if the i-130 is approved we no longer qualify for a K3 visa? Our i-129 and i-130 were approved... What do we do now?

Choose which route is best for you & which one is the quickest thru the Consulate nearest you... everyone has different priorities and different reasons for choosing the path they do...
Good luck!
