My husband received Packet 3 today and they asked for I-134 and I-864 to be taken to the interview. Do I need to send him both notarized??? Do I need three years of taxes? Please let me know. Thanks

The new I-864 dose not need to be notarized but the I-134 dose. The Instructions for the I-864 states 1-3 years tax returns, copies of (1040, W2, and any 1099s) also recomeds having a note from employer, and 6 months worth of pay stubs.

If you are not using a co sponsor use the newer I-864EZ, less documentation is needed.

Can you do me a favor and post back here after your husbands interview as to whether the I-864 was actually required in order for a visa to be issued.

What visa is your husband applying for?

Your personal information indicates that your approved I-130 petition passed through the NVC in 1 week's time. I don't think so, there something you're not telling that needs to be known.

This is for the K3 visa. My I-130 is still at NVC and they just rcvd the $70 fee and the DS3032 that my husband emailed. I-864 isn't generated yet. The K3 was completed and sent to the Embassy in Colombo on the 11th of August and my husband got the info for the interview, which I think is the packet 3, on saturday and it says, on the list of things that he needs to bring to ther interview, I-864 and I-134. That was what I needed to know. They havn't given him a specific date for the interview. The letter says to come in any Tuesday or thursday at 1PM for the interview with the medical reports and everything. So as soon as he gets his medical reports done, he's going to the embassy. I didn't know that you needed the I-864 for a K3 interview, so I need to send him that as well.

I suspect a misunderstanding somewhere along the line. An I-864 should not be needed for a K3 visa. The K visas are processed by immigrant visa units, and immigrant visas do require I-864. The information put out by different posts is not always good at making this clear, and many visa applicants are not always good at making the distinction, either.

Try to get a look at what your husband is reading youself - maybe he can fax or scan and e-mail it to you if he hasn't already.
