My friend(USC) and her husband just filed for AOS they want to go to his cousins wedding in Spain in December. She wanted to know if she sent in the AOS with the AP for December and they don't touch it, can they still go? Will he be re-admitted to the US without the paperwork being okayed if they at least submitted it?

K3 visa allows travel, K3 visa is a multi-entry visa.

If he is here on a K1.. no.. one cannot be readmitted into the US unless one has an approved I-512 AP document in their hand prior to their leaving the US

If he is here on a K3, then one can travel on a K3 without the need of a AP document.

Your friend and her husband did not read the section of the I-131 instructions that apply to Advance Parole when they filled out the form? Or they forgot what they read .....

I don't think she read them to be honest. I didn't know because my husband and I arent filing for AP. I'm sure she'll figure it all out. I just thought I would ask.
