Full Version: K-3 Visa Manila-Has anyone been approved using a co-sponsor

GarynMarie
I went to the embassy in Manila in January and was told that they will not except a co-sponsor for a K-1 Visa but they will for the K-3. I really would like to hear from someone that was approved using a co-sponsor at the Embassy in Manila. I have to use a co-sponsor for Maries K-3 because of the fact the company I worked for laid me off and after some time went out of business leaving me without income(except unemployement compensation) for about 7 months. I read a thread that said Manila is not excepting co-sponsors-period! which is not what the immigration officer told me when I asked. He said they will except a co-sponsor for a K-3. I really would appreciate if anyone who used a co-sponsor in Manila and was approved to please post your story-I am nearly in tears with the thought that we might have to wait until the end of year 2007 to apply so I can get a full years work under my belt in order to meet the guideline. Thanks -Gary

Hi GarynMarie...

I had a co-sponsor during my interview (US Embassy - Manila) because during that time, my husband's ITR was below the poverty guideline since he just graduated from college and was just new at his job. But we didn't just relyed on our co-sponsor. He also provided a letter from his boss and pay stubs (3 months). At the interview proper, the CO asked about the co-sponsor then he looked at my husband's pay stub and the reason why the ITR was below the poverty guideline...he noticed that my husband just started work and he started in the last quarter of the tax year. The CO was cool with it. I guess it depends on the situation but try it anyways. The only problem we have right now is that my AOS is pending because we didn't submit a co-sponsor for that thinking that the CO at the US Embassy was ok without the co-sponsor even if we showed it to them that time. It's different here, they're more strict plus the additional fact that the co-sponsor has to provide proof of their citizenship...somehow their passport isn't enought as a proof wacko.gif

So, yeah...in my case they did accept a co-sponsor. Give it a shot at least you tried...plus she's already your wife, right. Good luck and God bless

I hope that helped.

ck,

Current, sustainable income is what counts, past income history may be a guide as to whether or not the current income is sustainable. In your husband's case his current income was adequate and his income history is not negative, it could be considered neutral to positive. So it may be that your husband was accepted as your sponsor and the alternate sponsor that you offered didn't need to be considered.

Has the USCIS asked you to provide a Joint Sponsor for your adjustment of status?

Hi Yordak...

With my AOS, they did send us an RFE asking for a co-sponsor. We even sent them his pay stubs, bank papers, insurance stuff, assets, employment letters, etc. but they ask for a co-sponsor. We didn't think of putting one with the AOS since the CO at the US Embassy in Manila disregarded the co-sponsor. Now this RFE with my AOS is pending my EAD mad.gif which I went for an Interim EAD and wasn't lucky to get one. I was told to just wait since my papers are already at the USCIC Local Office here in Seattle. wacko.gif

Looks like a K-1 won't be approved with your low income because joint sponsors are not accepted by the US embassy in Manila. I don't think the US embassy in Manila doesn't accept co-sponsors with the K-3 either. So far I haven’t found a definite answer from VisaJourney if anyone had income below the poverty line and was approved with a joint sponsor using a K-3 through Manila.

If you want an approved visa it looks like you have to get married and file a CR-1 in order to use joint sponsor. This is what I have found out and believe, but would like someone to chime in with an alternate answer.

Hi,

Our friend/schoolmate petitioned his fiancee who's also our friend/schoolmate late last year. He didn't meet the poverty guideline since he just got out of school in the Philippines and moved back here. Anyways, he got his parents as his co-sponsor and get this, SHE'S UNDER K-1. She just got here last month. She said she didn't have a hard time during her interview. The CO did ask her the reason why his Fiance has to use a co-sponsor and she explained that he just graduated from college and that he's reviewing for his licensure exam for him to practice his profession. It's really unpredictable sometimes. I was under K-3 and my husband had a co-sponsor because he too just graduated from PI and was reviewing for his lincesure exam. He worked part time here and so did our friend. Just make sure everything is prepared well and complete. That you should be honest and show that your relationship is true. Good luck!
