hi all

i got an approval for both of I-130 and I-129F
i just wonder which one is faster to get the visa

if i want to cancel i-129F, do i need to write a letter or not to NVC???

any advice

Your K-3 will go to the Embassy very soon while your CR-1 will be at the NVC for about 2 months. You have to decide your choice. Your spouse can go for the K-3 interview and come to USA with K-3 visa, then adjust the status in USA. Should you decide to go this route, then you can cancel the CR-1 process, once your spouse is in USA. Or your spouse can come to USA with K-3 visa and then go back to the native country for CR-1 interview. For now, you should let both cases go forward and then decide later on. When you decide to cancel a process, you should notify the NVC.

Another scenario is dependant on the timeframe of interview and this varies between consulates. When the NVC process is complete (which I note you have already started with the I-130) and forwarded to the consulate, if it arrives before the K-3 interview, this application will over-ride the K-3 and the applicant will interview for the CR-1. Whether or not the consulate maintains same interview date or they reshedule is dependant on the consulate. You can also hold up the K-3 process at packet 3 stage to allow the I-130 process for the CR-1 through NVC to catch up. As I said above, once the approved I-130 and CR-1 application is at the consulate it will over-ride the I-129F for the K-3.

If you reapply for adjusted status here it will cost you even more money, after spending so much on the CR1 process. Why not come here on the K3 and return for the CR1 Interview when it is finished soonafter, to get the adjusted status quicker.

It's a short and inexpensive trip for you to return to get the adjusted status much quicker than reapplying after you get here!

We are in the same boat. Both Visas seem to have completed processing at the same time and we have received a letter from each stating that they are on their way to the Embassy. There is no question in my mind which visa to continue with at this point and that is our IR1.

It will be interesting to see which interview packet arrives first, the IR1 or K3 and if the K3 gets the over ride.
