Well we finally got my wifes visa and got here over here smile.gif

Now we need to get her 2 daughters here. Since We did a DCF for her visa Im gonna have to read the guides on here to get them over here, I take it I need to file file 130s for both of them and send them off to texas ( I live in New Mexico). And go from there.

Anybody have any idea of the wait we are going to have to deal with?

If anyone has any other tips or info, it would be greatly appreciated.

Are her children under 21. Everything I've read says that helps greatly. I'm trying to do the same thing except my stepson is visiting us now. My wife wanted him to be able to apply here but that doesn't seem possible. If you can't get any good information from the guidelines and FAQ's, then I would suggest you contact an immigration attorney for at least a consultation. You should probably get references about one to see what is the background. I'm not familiar with DCF filings. Sorry.

I'm not able to answer this question, but I know that your Congressman is able to help you. Call your local office and/or the office in Washington, and ask if you can speak to the assistant that handles these things. I think you'll be surprised at how much help you'll get.

Why were they not included in the original petition?

If smoedog's profile and the thread title is accurate, it looks like his wife was in Korea, but the stepchildren are in PI. Actually, if I remember correctly, the critical issue is at what age the marriage occured when dealing with stepchildren

Under or over 18 is an issue as far as his ability to sponsor them is concerned, but I do not believe it matters where they were as far as including them in the original petition.

Guess I should have put more info. They are 8 and 10 right now. They were put on her petition that we filed at the consulates office in korea, but we didn't file seperate petitions for them. Now that we are back here in the states I need to know the process.

Also, when you guys are talking about putting them on her original petition do you guys mean Section C Line 17? Cuz thats where I put them

How Do I Bring My Child, Son or Daughter to Live in the United States?
smoedog
I've already been there and read it over. But like I said, Im not familiar with filing over here in the states. I filed in Korea with my wife.

But let me give this a go. And correct me where I am wrong.

I file the I-130 at the Texas Service Center.

Then wait the year or more for them to approve it.

The Packet 3 or whatever is sent to them in PI.

They wait another 6 months for an appointment date in PI to get there Visa's.

I miss anything?

Boiler,

How do you know they were not, and what difference does it make either way?

According to that Site and this quote "the principal applicant gained lawful permanent resident (LPR) status," does she fall under that category with a CR-1 Visa? And If so, what does all that mean. I can just fax them the info they request and they will pretty much just issue instructions on how to apply for a visa? No petition required?

Yes you file a I-130 for each of the kids!
if your service center is Texas then they will be transfered to California, (not a year) look at the processing dates for CSC!!, once approved at the service center, they then go to NVC, where you will have processing fee's to pay, as for how long after you have case complete at NVC to interview in PI i have no idea each country is different!!
Good luck good.gif

EDITED to say..........................You as a USC & also the childrens stepfather will have to sponser them not your wife!!

CR1=married less than 2 years!, conditional resident!!
