Full Version: K1 visa elligable for a work permit upon POE?

It was unclear as to where I need to post this, but since it's k1 realated (or the tail end of it) i'll
post it here.

If my fiancee has a k1 visa, is she elligable for a temporary working permit (I think it was a 90 days)?

If so, will she be able to get one at the LAX POE? She will fly in from manila to LAX and then from LAX to Philadelphia.

She has a good job opportunity window open until the end of November, so if she can start working that would be good.

I hear New York can do it, but can others? She wont be flying to New York.

Dunno...I think I remember reading where someone got one through LAX, but JFK is the one that is known for doing this. Best wishes!

Only place that seams to give it is JFK and its only good for 90 days then she would need to give up her job and wait for the 1 year EAD she will file for along with her AOS.....

I'm also going to be marrying my fiancée on a K-1 visa - hopefully in the next six weeks or so (fingers crossed!). I'm a Brit and just waiting on the final bit of approval (I-134).

The 90-day EAD would be a great help if I could get it at a POE. I work in IT and I could lots of little, short-term jobs whilst I'm waiting for the EAD as part of the AoS (I hear it takes three months or so to get the EAD for that).

Are there any hints and tips that anyone can provide in order to enable me to get that. JFK sounds like the place to go, but do I need to specifically ask for it? Are there any criteria I have to meet in order to get it?

I'd rather do some short-term work than sit on my hands for three months if I can help it (especially as time 'out of the game' is a big thing in IT).

From what I have read others post on here, JFK seems to be the best POE for getting a temporary work permit. But no matter what your POE, all you can do is ask, and it does not sound like there is much by way of rhyme or reason to getting one or not.

Ask... That is all you can do.

good luck in getting temp EAD - I have booked my flight in through JFK with the hope of getting one. My work in the UK are happy to continue employing me until Jan so a 90 day EAD would mean continuing to earn a salary while looking for other jobs which would be very nice :-)
I guess if I don't get given one I just have to resign ASAP.

Your situation is different enough that it would be worth you getting ahold of a lawyer to discuss your *particular* circumstances.
You are employment authorized by virtue ofyour status, for your first 90 days. The issue typically is not having the evidence to be *hired* by a *US* company.
Could be worth the hundred bucks or so to find out for yourself...

In my opinion she will not be here by the end of November, many people have a three month wait from their I-129 approval until they have their interview in Manila. My wife had her approval the first part of Jan and her interview was the end of April, plus another week for visa delivery.
