4) Getting an immigration lawyer is upto you. I have heard cases on VJ where lawyers have screwed up things for their clients. The process is listed on this site and if you have the time to do it then there is no need for a lawyer. I am doing everything by myself, thanks to the site here and all the VJ users. The lawyers in India are no help as they do not know the process.
5) Check the "Processing Times" tab at the top of the page for average processing times.
6) You will have to do the traditional marraige first because the Indian court will require a few photographs of the wedding as well as the wedding invitation card at the time of registration. Alternatively if you marry at a Gurdwara then you will also get a certificate from there which will speed up your process at the registrar. You should hire a lawyer in India for the registration of the marraige. Your lawyer will specify what you need to bring to the registrar. There are other options also if you do not want a traditional marraige and instead want to opt for a civil ceremony.
7) Your fiance does not have to stay in India for a specified amount of time after marraige. She can marry and immediately return to the US to file for you.
Another option is DCF (direct counselor filing) at Delhi embassy. The new rules for that are the US Citizen has to stay in the India for 90 continous days. The US Citizen also has to have a employment visa in her name and must be working for a company there. If you cannot satisfy the work visa requirement then the USC has to stay in India for 6 months. If DCF is done then the maximum time for you to get visa for the US would be 3 months.
Can you pls give more information abt d dcf from delhi???
is it different from k-3? or if v hv applied for dcf then v shud for k-3 or nt
