So STEP #1 We get married (obviously) STEP #2 - File nessary paper work STEP # 3 How soon am I able to return to Canada to visit family (what if there is a emergency?)

I have heard there is a 6 month wait before you are able to leave the country? Does this cover children as well ? What if the kiddies are to return home for a visit (with thier dad) Does it only involve me? What paper work haas to be completed before you can leave and how quick can I start hopping borders?

Thanks guys, sorry panic has set in and I am worried about crazy stuff. unsure.gif I'm sure nothing will happen back in Canada, but the what if's are making me nuts. So who knows the answer?

Basically, to leave the country while your AOS is pending, you'd need to apply for AP.

After marriage, you send Form I-485 (Adjustment of Status) in to USCIS, along with Form I-131 (Advance Parole) and Form I-765 (Employment Authorization).

You can just apply for I-485 if you want, the I-131 and I-765 are optional, but you wont' be able to travel until either the I-131 is approved or you get your Green Card.

This also applies to any K-2 children that accompany you.

My daughter applied for AP last September 7/05 and was approved on October 24/05.

Not to be nitpicking, but as soon as you receive the AP document you may leave (not just approved).

Well if we are gonna nitpic then..... there is nothing to stop you leaving the country once you have been approved and then have someone send you the AP once it arrives so you can get back in..... You do not need an AP to leave the States you only need it to get back in......

Well if we are gonna nitpic then..... there is nothing to stop you leaving the country once you have been approved and then have someone send you the AP once it arrives so you can get back in..... You do not need an AP to leave the States you only need it to get back in......

I wouldn't recommend doing that - something can happen, it can get lost in the mail, your AOS interview can be scheduled on short notice and your AP not yet arrived - much safer and better to wait until you get the AP in your hot little hands - then you KNOW you're good to go - AND come back!
