Good morning all,
I am trying to find out some information for my Sister-in-law's boyfriend,
this is the case helpsmilie.gif helpsmilie.gif helpsmilie.gif ;
In 2000 his grandparents filed for his parents himself and his sister. Then he was 16, the case has been approved and sent to the KNG embassy however everyone else is getting through ok except for him. They are saying that because he is over 21 that he cannot get the visa. He will be 22 in October.
Is there anything he can do?
Please can someone help me out.

Sounds like he aged out.

His parents will be able to file for him when they get their Green Cards.

Sounds like he aged out.

His parents will be able to file for him when they get their Green Cards.


Thanks Boiler. I was just wondering if there was anyway he could be grandfathered in or even filed a waiver or something. I guess he just have to file for hisself or wait until his parents get here.

Assuming he did age out, then it is a question of fact not opinion. Including whther he grandfathered in, I think he would need to be of the age when his parents visa Number came up.

Waivers are for grounds of inadmisability.

If he has a way of immigrating other than through family, work is the usual other option, then that is another route.



Just thinking, you said Sister in Law b/f, can she not sponsor him? Not clear where everybody is.

My Sister-in-law is Jamaican, she just asked me to find out where her boyfriend stands because I am going through the process with my husband - we just got approval of bot CR1 and K3 and is waiting on the NVC to send of K3. My SIL has no intentions of coming here- except to visit but her boyfriend just wants to know because his parents were just called in for there visa interview and he was told no.
