Hi guys,
I need advice here pleasee... helpsmilie.gif
I got approval with my i-129f and i-130, and i am waiting for the next step. I read many VJ's pros and cons with continuing i-129f or i-130. I am still confused and get black area in my mind.
We' ve married for 1 year . My thought are:

1. lets say i enter US with K-3 visa,(cause i cant wait live apart any longer with my hubby) and i am not back to my origin country for i-130 interview ( i am thinking to have the interview in US) , what kind of process i should take, situation i would get through and how long the process will totally finished ( more than 3 years? )

2. After i finished the process i-130 interview in US , what kind of visa i get? IR1 or CR1 ?

If you are wanting to adjust status in the US from the K-3 and your approved I-130 has been forwarded to NVC, all you need to do is inform NVC that you will be adjusting status in the US from the K-3 and they will return the approved I-130 to USCIS.

The length of time the AOS process takes is dependent on many things including which Office will do the processing, some of which can take up to a couple of years. Security checks can also add various timeframees to the length of processing and there is no way of catagorically stating how long this would take as it varies.

There is no visa to be gained from adjusting status in the US from a K-3 as you have already entered on a visa. What you are doing is seeking immigrant status which will be conditional if you are married less then 2 years on it being granted.

Based on the above excerpt I took from your post, I think I read your question(s) differently from the other respondents. Are you asking if you can enter the US with a K-3 and then do the interview for the I-130 process here instead of Indonesia?

Lorelle, if this is what she means, maybe you can explain this as well. The answer is 'no', right?

1. If you enter as a K3 and do not wish to return to your country to interview for an immigrant visa then your alternative is to apply for adjustment of status from non-immigrant to Permanent Resident here in the USA. Send form I-485 to the USCIS. How long it will take depends to a great deal on where you are located in the USA.

2. There is no "process i-130 interview in US", no visa. See item #1.
