Yup I remember you. I hope your process is moving steadily. I think you were one of the few who was hoping for a quick DCF process also but got shafted. Anyway, just count your blessings... things will work out.

She's working for Navy Federal Credit Union. If I ever get stationed overseas somewhere... there's always a Navy Fed Credit Union so while I'm in, she'll just work for them in the meantime...

I just now read a post where the American Embassy in London denied someone of their visa because they did not have a copy of their husband's 2006 tax returns. Now, perhaps their situation is different because they are already married, I don't know.

The instructions on the I-134 states that the tax returns are needed if you are self-employed, but I do read a lot of posts of the sponsor sending over their tax returns. Can anyone clear this up for me....are they really needed? I am not self employed.

Kym, I saw that post too. He needs to file the I-864 or I-864EZ with his 2006 return. I am not sure about the I-134 but I bet it has pretty similar requirements.

The issue is that the sponsor (husband or fiance/e) is required to file the most recent tax return (or have a really good reason for not doing it). I saw he asked for an extension but the reality is he can file married filing separate. I filed jointly and our ITIN is still pending (damn IRS backlog and USPS mail screwups on tax day argh). Anyway, I thought about it and don't see that as an issue because my salary is still my salary regarding the numbers game and the 125% poverty line. I see the issue in that he technically can't provide sufficient support until he files the 2006 return (jointly or separate). I have filed (and have money owed to me) and that is what really matters. I am hoping though in my case that the filed return is processed by the time our NVC process is completed and the wifey goes in for the consulate interview.

So to answer your question, I would suggest sending a copy of your 2006 tax return and W-2, 1099, etc in with the I-134. It doesn't hurt. Then be prepared to send another copy with the original W-2 etc, to your foreign spouse / fiancee for the interview as backup. That could possibly save you heartache like that other poor couple. I do see that it's an easy issue for them to resolve so that's a good thing. They were denied on a technicality which can be addressed.

I'm more worried about stuff being mixed up or lost because of this APEC thing. But eh, I'm trying not to worry too much. tongue.gif

hee hee I know what you're feeling. I got very anxious about things like that. I don't think you need to worry about APEC. I think that APEC will be over by the time your things are sent to the consulate, and it will be business as usual.

Hey, it might even be quicker since so many people rushed to get their interviews before APEC? *wishful thinking*

Don't worry too much, just read everything you can on this website, make sure your petition has everything included so you make it easy for them. It will be just fine. Despite what you might read on VJ, even though the visa process is very tricky the people dealing with the applications are a well oiled machine and mostly everything goes through just fine without mistakes. It will be just fine!

Long time reader first time poster on this thread.
Backgound on me: well i'm an aussie who went to America for a holiday and met the love of my life, i stayed there longer then she came to Australia where i proposed. Now we are in the process of getting a K1 Visa for me. I got the NOA 17th may 2007 and now are waiting for the NOA2. I am actually flying back to America on August 1st as i couldnt wait any longer!! all i have to do is get through the immigration and i can finally see my girl.

My question relates to people who are allready in the States really...I have read conflicting things on this: When can i work over there once i land with the Visa in my hand?
Has anyone got the POE, EAD stamp? or is that wishful thinking?

Hi JonOz! Welcome to the DOWNUNDER thread!

To answer your question... You can work in the US only once you have actually received your greencard. This can take varying amounts of time and you will read about people who get it within the first couple of months, and others who wait a year or more. I'm not sure what the current situation is and others may be able to shed more light on this time frame.

The other alternative is to send in the form 1-765 (Application for Employment Authorization) at the same time as you send in your Adjustment of Status stuff. The current cost of this is $180 but it is set to rise before you get to the US, so this may come into play when you decide whether it is worth it, on the off chance that your greencard takes ages to arrive.

As for the EAD stamp at point of entry... its pretty much a magical unicorn at this point. biggrin.gif I hear that you can get it in JFK still, but since I'm not flying to JFK I haven't followed this up at all personally.

Darryl went for his medical with Dr. Waks last week. (whom he really liked, btw). Anyway, Darryl had a drink driving charge 20 years ago and they got to talking about that. Dr. Waks told him that starting next year (don't know the specific date) they are changing the rules and if you have had a recent drink driving charge or even a couple of them, you will have to see a counselor before going for your interview.

Has anyone else heard anything about this?

I DO know this...and try to remind myself of this very same thing....daily!!!! Darryl is the best...he knows what a hard time I am having over all this...and although he is too, he tries to be so supportive and opptimistic for me. It's really sweet.

We originally filed on June 12, 2006 and have now been waiting 391 days (as if I'm counting?). Not only that it has been such a roller coaster on the emotional side of things. Seems everytime I get excited, I get slapped back down again.

But as Darryl tells me...we have been through so much bullsh** before we even get to marry that once we are married and run into problems, they will seem like a piece of cake compared to all this!

~~This whole APEC thing has blown my mind now~~ On July 4th I was at my brothers house and was FINALLY allowing myself to get excited once again that we were actually going to have a wedding soon. After we had to cancel the first time around it was very devastating for me...so I have been too afraid to allow myself the pleasure to get excited. We had a very eleborate wedding planned the first time around and decided on something small this time! My brother and sis-in-law has graciously offered their house to have our wedding...we were thrilled. They live in a very nice area and have plenty of room...and was going to leave their swimming pool open until our wedding so it would be even more beautiful. We thought Oct. 6 would be perfect....enough time for Darryl to get here (if it weren't for APEC) and before it got too cold. On July 4 I finally opened up and allowed myself to start to get excited, me and my sis-in-law was even doing some planning of how we would decorate n such. (Of course the martinis helped to make it easy to get excited...lol). Anyway, it was a great day...until I got home and read Sharyna's post that evening about how APEC is now hitting and her interview is not until Oct. 10. Darryl's will probably be about a week after hers. Now I'm kicking myself in the a** for getting all excited once again and allowing myself this huge let down...again.

Ok...whew...that felt good....sorry about the vent there...LOL.

Oh well...we have waited over a year...whats a few more months. right? girlwerewolf2xn.gif

Hey sweety, don't let this be a let down for you until you have the facts ok. You have Congressional Inquiry and you will be put in front of others. Do not be sad until you know okay. You will likely get squeezed into an earlier interview slot. Chin up and do not think sad thoughts until the interview date is set okay. *hugs*

Congratulations on all of the approvals!

I have to admit that I'm also a bit dismayed to hear news of Sharyna's October interview date. Meowboy has his medical on July 23, so we won't be able to send the statement of readiness until August, probably, which might mean a date in November!! This process is frustrating.

I have been gone a minute but so much as happened and I have not had as much time to keep up. I think Kevin is enjoying it here. I have asked him a couple of times if he misses Australia and he says no...so I have to assume he is doing ok. I am so happy that he is here and I enjoy him being here. He has made my life much easier and happier. He is a good man. wub.gif
We will be getting married on 7/14 on a beach in Galveston Tx here. We are being married by an British Reverand. Teehee. It is not going to be a fancy affair. Casual just a couple of friends watching us get married on a beach. This will be a 10 day planned wedding as we barely got cracking on it last week. We are determined to finish this out and have his AOS in the mail before 7/30 so we are cutting some corners and cutting it close. ohmy.gif

I've read on this board that it's inadvisable to attempt to enter US while the K1 is in progress. You may be denied entry at the border if their computers show that you are in process for a K1 and as such you may be tempted to stay illegally. Though if you're going to try it anyway you should supply ample paperwork showing your ties to Australia (e.g. letter from employer stating that you're employed and vacationing from what to what date, bank statements).

I've read on this board that it's inadvisable to attempt to enter US while the K1 is in progress. You may be denied entry at the border if their computers show that you are in process for a K1 and as such you may be tempted to stay illegally. Though if you're going to try it anyway you should supply ample paperwork showing your ties to Australia (e.g. letter from employer stating that you're employed and vacationing from what to what date, bank statements).


My fiance came to visit me back in April. Although he did not enter via the visa waiver program but rather had a B-2 visa (for other reasons). When he came through customs at LAX they asked him what his reason for coming to the USA was and he answered to visit his fiance. The man went through his paperwork (showing ties to Australia) and they let him through. Darryl said he was shocked but it was all no big deal to them.

However, I have heard of other stories just the opposite of people having trouble if they know you are visiting your fiance with a K-1 pending.

anyways i did get a reply from the consulate - 10th october it is - no typo DAMN!! lol....

and they said that my fiance was more then welcome to attend my interview with me and they jotted him down as attending ......... even tho i said that he may visit.. (MAY VISIT) guess they skipped that bit lol.....

Aww... It sucks that you have to wait so long, but at least you'll have plenty of time to prepare for it! Plus, your fiance may be able to attend the interview when it comes around. That'd be awesome. star_smile.gif

Awww I was so hoping that it would be a typo! We can only dream eh? The time will fly by, I promise. For me, I had my interview and had to stay in Australia for another 2 1/2 months to finish uni.

So sorry that I have not posted in awehile guys but I have been a cleaning fool. Loke has seen this place a wreck (I have 2 small kids) but I still feel like if he has to start his life over, then so should I.

I have gone through everything and been throwing away so much crap! It feels good, but it has been a lot of hard work. I am so excited. I remember when I thought that we would never see the day that he would finally come home. I know how hard it is for those of you to wait especially when you are watching others rejoice in their happiness.

hang in there guys and gals...i was handcuffed and shackled and dragged away from my family when they claimed my wife, who was standing by my side at the time, withdrew her support. Its a long , tough road, but think of the prize at the end....your loved ones.
It seems a long time going thru CSC, but most of that wait is fbi name check. If its any consolation,CSC approved our I-130 and I-129f on the same day. It was then sent to NVC who immeadiatly passed it on down to sydney. We were expecting more paperwork and fee's, instead, we just seemed to jump the entire step. So keep your chins up.There is light at the end of the tunnel
My interview in sydney is scheduled for 11/7/07. Wish me luck, and thanks to you all for your advice

I try to stay positive - not just for me but for Rings, who I love and cherish and worry about, and who I want to be strong for. I don't always succeed. Many of these days I feel like I am only half a person, trying to fill my days with things that might mean something to anyone else but to me they are just ways to get through the time while my life sits on somebody's desk waiting to be processed.

Just remember that although we are happy, we do remember where you are and what you are going through and we will never forget the pain and the sorrow involved. We are here for you to support you and hold you up in the best way that we know how.

I know this process is hard and it's not only hard... it's horrid and hurtful and mean and unfair... there are no words that do the pain justice. There is nothing anyone can say that will seem right or that will take away the ache, but knowing that we do know and that we do understand and that we have gone through it may at least help you in knowing that you are with people who understand more than you think and that fully support you.

Remember to wish those who have sucess well and remember to try your best to help those who don't because we are all in the same place, just different areas.

I got up to level 10 at 7.45 and my appointment was set for 8. There was a line for the first security point. But the time I got to level 59 and took my ticket it was around 8.15. I got ticket 3. Hey, if you get there at 7.30 on the dot you may very well get ticket 1. Getting ticket 1 or 2 is preferable since they only have two windows so they do two lots of people at a time. Still, even though I was number 3 and had to wait for number 1 to finish, I was still out of there by 9.30 biggrin.gif

a quick question. i checked the guide for the affidavit of support, and it stated that there is a second form required for sydney (financial responsibility under the social security act). meowboy did not send me that form to fill out. is that really required or is the guide incorrect?

Also, shoudl I jsut estimate the cost of my car (other personal property)?

Yup! Only one affidavit of support form needed AT THIS STAGE smile.gif Some other countries are different I have noticed.

At the Adjustment Of Status stage, another Affidavit of Support form is needed, but for the interview, just the one for the K-1 Visa!
