Elle hi there ...hell -2 aint nothing we been having -11 here the coldest it has been is -14...and this weekend its going down to 0.F...i thought when it snowed you could just go out an throw snowballs but the snow is too light to compact into balls lol..im waiting for a good snowfall to make my first snowman since i was 7 when i made my last one...hope you hear something real soon about your interview date...packet 4 is just the interview date and instrtuctions on what to bring with you and in what order...

Yes, packet 4 is the interview letter and instructions for things to bring, also instructions to make certified copies of certain things, like copies of the police certificate and such. When my wife went for the interview, he basically took the basic information that was on her previous applications and asked her basic questions about them.

He basically mixed up answers like...

Interviewer: "So you were born in the Philippines?"
Wife: "Noooo, my husband was born in the Philippines."

Interviewer: "So you got married on Sept 15th?"
Wife: "Noooo, we got married on Sept 16th, my birthday is Sept 15th."

Interviewer: "You guys got married in Florida?"
Wife: "Noooo, we got married in Las Vegas, my husband lives in Florida"

Instead of asking her a question, he basically mixed questions up, making my wife correct him. It was very easy, and my wife was giggling the whole time, wondering why he was trying to confuse her... but my wife kept correcting him in a sarcastic tone... She said it was too easy and the guy was very nice.

You have nothing to worry about, just have all the forms in order and follow the instructions.

To everyone else, thank you for the support. It's been full-on but I'm not too worried about, nothing will keep my wife and I apart.

I had the same experience with the questions too. He tried to throw me off but it was too easy. He just asked things from our petition. Also asked if I had ever committed a crime even though I had the police certificate.

Pack 4 contained the medical exam info, police certificate info, checklist for the interview and interview letter.

Hi everyone! Congrats on the couple that just got approved ^^ that's so wonderful to hear!

My name is Cherie and I'm currently engaged to an Aussie from Melbourne. We were going to do a DCF after a July wedding here in the states, but with the new policy we're going the route of the K-1 visa and getting things assembled so I can send everything off. Any advice you have as far as filing a K-1 would be helpful! I look forward to getting to know you biggrin.gif

Welcome to the Aussie Forum. You will find everyone helpful and friendly here. Make sure to read up in VJ about the K1 Visa thoroughly that way you won't get an RFE like we did! blink.gif

welcome to the aussie forum glad you found us...i am from melb too now living in toledo ohio..and i did the K1 journey ...robert and i compiled our petition while being on msn..sending back and forth scanned pages and both of us checking that it is correctly filled out...it took us a whole weekend to get it complete .. so say your biographical information sheet is complete send it to him to check then he does the same thing..this way any mistakes you missed he might catch an it can be corrected...do one thing at a time make copies and put aside then start on another section say your evidence ... keeping everything seperate is the key then putting it all together in the order it needs to be...we did it and we got a quick approval...i know it sounds methodical but it does work...you dont get frustrated by doing it this way..you know the section is completed and doesnt have to be looked at again...

the only other bit of advice to give you is be patient...this process can be so frustrating and it doesnt stop until your a unconditional citz in the states...

your welcome to post any questions in here even if its been posted before we are a friendly lot and here to help our fellow aussie/american mates....

i use to live in melton where is your fiance...and where will you two be in the states...

Kath is right be really methodical and you can't go wrong. It's a long haul so come in here and chat/vent ask questions when you need.

then she has to fly out back to Massachusetts.

But i will make this trip exciting and fun for her and i.

Going to do a road trip to Victoria on the 12th Feb - 18th Feb.

Going Mt Gambier stay the night there explore the blue lake,'

then on the Tuesday drive along Great Ocean Road through,

Warnnambool to Apollo Bay to Sorrento Ferry to go see my sister,

in Mt Martha Victoria.

Take out time so Cheryl can take lots of pictures idea9dv.gif

Ok well time for me to ring and catch up with Wifee.

15 and a 1/2 hours difference between,

Adelaide and Massachusetts.

so i call at 1.00pm Adelaide time Sunday Arvo

it will be 9.30pm Saturday night there.

I get good phone cards here in Adelaide.

Get one called "Daybreak"

a $10.00 card gives me

258 minutes, or just over 4 hours of talk time.

But if you ring after 1.30am local time (Adelaide)

it goes out to over 2000 minutes or 33 hours kicking.gif

Anyway's I have Waffled on long enough.

Hi Cherie, I'm from Melbourne also (Elwood). Joshua and I have recently married with the intention to do DCF but in light of the recent changes we will be at least starting similar to you also. Now that our official marriage certificate is finally here we can send off the petition this week...!!

Australian hospitatlity is fantastic as always! Thank you so much for your welcome! Rob currently lives in Box Hill (I spent 5 months with him there last year). I miss Melbourne! Such a lovely place and I loved being able to go anywhere and not having to worry about driving! The people were just wonderful as well and I can happily say that should we ever decide to move back to Melbourne, I'd be quite happy there.

I am currently waiting for a few forms and copies to arrive in the mail from Rob (my fiance) and next weekend we're planning on going through things and triple checking everything so I can send it off by Valentine's day to get the ball rolling. Patience DOES seem to be a needed value with processing times and the tedious work of filling out forms. I'm just grateful I ended up deciding to live with him as that will help our case for proof or relationship. I get to see him again in March, so we're fortunate to not have to go so long without seeing one another. Any more advice on filing for the K-1 is always welcomed!

From the US Consulate Sydney website:

"The U.S. Consulate in Sydney will be closed to the public for routine services from 12 February until 23 February 2007. Exceptions to this closure will be made only for the U.S. citizens in emergency situations and those scheduled to collect previously processed U.S. passports and Consular Reports of Birth."

I wonder if they will use this time to iron out the procedure for those in limbo with the DCF. Or is this really a routine closure?

just looked at the closure thing on the embassey website..melb, canberra and brisbane are closed the others arent..also i looked at bangkok website to see if they too are closing seeing the applications are being sent there and they arent being closed...

my question to all this is ... is it a background check on the U.S. citz or the international citz...
if it is the U.S. citz why cant they get the citz to get a police check completed with the application..as the overseas fiance has to get...wouldnt this save time and a transfer of the petition...?

if im wrong someone clarify for me please cos im a bit confused over this one...

I got an email from the Sydney Consulate asking them what they will be doing to my I-130. I told them word for word what they told my wife at her interview. So I asked them what they know about Bangkok and what instructions were they given about Bangkok.

Well, I got an email stating that they have not recieved any instruction from the Department of State as to what will happen to the pending I-130.

So I'm asking myself... why did they tell my wife that my I-130 will now go to Bangkok to get a background check? This is frickin' ridiculous. I'm sure the Sydney Consulate is just as confused as everyone around the world... that's why they shouldn't be telling people false information. Until they have it in writing. That's why I asked them what they knew... apparently they are clueless. mad.gif

i hear ya frustration over all this and i know were all keeping our fingers crossed for you and the other DCFers...

if they are going to bring out this new law why the hell make it so if all their embassey's arent informed first on how to handle it..it makes no sense to me..

i read somewhere about the fees going up and the bloke commented how can they increase the fees when the standard of work being done isnt up to par (not those exact words but close enough) and he is right....it goes with everything right down to bringing out new laws and not letting the left hand is to do when the right hand makes new laws...

hope you hear something more positive soon david..

Hi Folks,

I saw this regarding the DCF process and an hoping the Australian Consulates may also follow suit. Apparently, some consulates are allowed to accept the I-130s again but the USCIS office will be performing background checks. I am guessing that the Bangkok USCIS office would be doing this since they have jurisdiction in this region.

I hope the Australian Consulates post some news about this. I am on the verge of filing a K-3 / CR-1 for my wife and want to know if I should hold off to try a DCF in April.

Some news about how they may handle DCFs moving forward...*Fingers Crossed*

Now my only concern is how the Bangkok USCIS office will handle USCs that don't live in Australia. Assuming that this new process will be implemented I hope that their only purpose would be to perform background checks and not pass judgement on living abroad (or lack thereof).

Agreed. I would expect that the "not clearly approved" cases are waiting ONLY for background checks (Adam Walsh act) and nothing more.

Lyndell - first week with visa in your hands! Well done! I liked your review. On Tuesday I went to Dr Millar's for my medical and walked through Martin Place, checked where the lifts are to go up to the consulate. Hopefully I will need them some time soon! Anyway... it was exciting just to think about it!

By the way... all who did medical at Dr Millar's... did you find him to be very kind, very nice, easy going and just so "young in heart" and in good spirits? And his secretary showed the same kindness, understanding, friendliness. Nothing like an official visit to a doctor you've never seen before. I'm thinking of sending them a thank you card once I receive results from the secretary!

May the confusion about the DCF be resolved real soon and you guys caught in it back on track! Let's hope this 10 day consulate closure they announced won't affect any of our timelines!!!

Priscilla - there are a couple of threads in the DCF forum which talks about "DCF being back" in a different format, without I-130 same day approval, rather the petition beint sent to a USCIS office for a background check. So I imagine for Sydney, you do a walk in, they send your petition to Bangkok or whichever USCIS office. These are all rumors for now though. WHO KNOWS!

As I mentioned the Consulate is closed for two weeks so maybe after reopening they will have had official instructions from DOS. Like vylex said, I would try to hold off and see.

My name is Rings and I am new to this forum. I was invited here because Loke is in Australia and I am in the USA. When I file the I-130, I was supposed to send it to Nebraska. I was going to mail our petition on monday, but I have been scanning this thread and I noticed that there are some issues and I didn't know if they pertained to us or not. I am at work and I do not have much time to go through the posts all the way until I get home later on tonight, but this has caused a panic inside me and I need to know.

Are they recommending that we do not file the I-130 until Sydney is all straight? if I do file it Monday like I planned do you suppose it would get caught up in the hangup? I am so worried about this. Any advice would be so greatly appreciated.

Rings, have you ever planned on filing via DCF for your spouse? If so, then hold off a little while longer to see what will happen with the Consulates. If you were never planning on that route and wanted to pursue just an IR-1/CR-1 and/or K-3, then file away as planned.

hey Rings, welcome.

The upset isn't with Sydney itself at the moment. Had you gone ahead and sent your petition to Nebraska, all would just chug along.
But, it might be a blessing in disguise for you. If you can hang on a little bit, there may be a stellar shortcut open to you. This is the process that is in upset at the moment.

Hi All,

I am the other half of Rings, living in Melbourne and trying to get my head around this whole immigration thing. My heart goes out to everyone going through this process, it seems extremely awkward and complicated just to be united with a loved one. We have only been apart 2 weeks after Rings flew here for 2 weeks and we married and already it is killing me.

I am still reading through all this stuff on DCF, I am not sure if it will be a realistic option for us even if the results are positive from the USCIS, but I will continue to read and try to understand in case it does present itself as an option. Best of luck to everyone and I hope to get to know you all as our journey progresses.

welcome to the aussie thread mate...which side of melbourne ya on..i use to live in melton (if ya know where that is) there are quite a few melbournians in here now...so im sure we can give ya tips on the medical and the police check you have to get when the time comes..

there is alot to get ya head around for sure but it gets easier as you read and learn about the process....the one thing that doesnt get easy is the seperation as you are starting to experience...just hang in there an if you need to vent go for it we all know what ya going through...

good luck to both of you whichever course you choose and hope its not a long wait..

which town you going to be living in..i cant remember if i asked rings when i pm's her yesterday...

Hi Kath,

I'm in Blackburn South, eastern suburbs...fair way from Melton but I know it. Going to be living in Denver.

I will take any hints I can get at this stage. It's all slowly coming together but I know we have a lot ahead of us. I think we're prepared for the I-130. Does it make a lot of difference at this stage how much extra documentation we supply? (my financial docs, evidence of legitimate relationship etc.) Or is that material more important at my end?

And don't worry, we will vent when necessary. Just finished a bit of that in private and she's sleeping now, I am going to spend my afternoon trying to find out about DCF and whatever else I can digest from wherever I can find it.

The people are great here and there is a lot of support, so you won't be alone during the waiting. smile.gif I lived in Boronia, Melbourne before I moved to Canberra to stay with my parents until I leave. So you will be based in Denver....I am moving to Colorado Springs about 1.5hrs away. Yay! Great to know another Aussie in Colorado.

Hi Ausqueen, thanks for the feedback. The day I went to the Consulate the guy that interviewed me wasn't in a good mood and asked a trillion questions. I just remained business like and it was all fine. I'm not telling you to worry you just so you are prepared. Glad your medical went well. The doctor I had in Canberra was really nice too.

Hampster, hoping Northern Girl has arrived by now and you are having a wonderful reunion! And...no the Wiggles did not have the big red car with them...maybe it was parked on the street laughing.gif

Hope all this I-130 crap is cleared up soon...what a stupid time for the Sydney Consulate to close!

Thanks for that information Kath and Meauxana - you guys are wonderful, I'm sure I didn't have half of that yet... would love more info on the doctors list or should I just wait for the packet and do the police check while I'm waiting for the I-130 to be received/processed. I have the innoculation list but that is pointless if I can't ring and speak to the doctor in charge. (I don't have a regular doctor and therefore will need to be checked for which ones I have had previously).

Welcome Loke and Rings! I am from Melbourne also (Elwood). My now husband, Joshua is with me here now where he has transferred studies to be here biggrin.gif we are just about to send the I-130 in preparation for the DCR, when we are sure where to send it. We will be going back to Arizona where Joshua will finish studies then who knows for his Masters...(he's from Chicago originally).

We had our reception in the outside cocktail bar at Waterfront in Port Melbourne. Good to see you, sounds like everything is fabulous. Well Joshua was thrilled when the bears made it to the Superbowl only to lose....sad.gif Still it's the best effort they've made in years so maybe next year....

Thank you for all of the support. It is so good to know that this is possible and it is very uplifting to see other people who really do understand. I am getting ready to submit the petition this week, but I wanted to see what you guys thought on a name change first. Now I have two certified copies of my marriage license and I can send them both off at once, but I am afraid that it may hinder or help me and I really have no clue which way it would be. I figured having the same name would be a good thing, but if they want to get picky because my legal name is changed during the process of submitting the petition then gah... you get me right?

I never changed my name; it doesn't give you any 'better' chance at anything--if you are legally married, you are legally married.

If you do want to change your name, it's best to stick with one name through your process if possible. You may start using your married name with the petition; your marriage certificate is evidence of your additional name. Your maiden name then goes under 'other names used'.
The act of marriage is a unique one, in that it allows a legal name change just by the act--no need for a court order or other document change (in fact, the marriage cert is usually the first name change doc--used to support the change in DL, SSA etc).

if you go to the embassey info for australia you will find the doctors for melbourne..there is one in the city and there is also one at monash both phone numbers are there...i went to the one in the city...he was pretty good .. the x-ray is done at the top of collins street when u go to him...which is done on the day of the medical

did you say you had the vaccination sheet already..if you havent go take a look at Thailand embassey website..they give you the forms to download in packet 3...i have double checked comparing to my copy i have of the vaccination sheet and the x ray sheet and they are the correct ones...

now for your blood test to see if your ammuned just go to any doctor...it can be done on medicare ...but if i remember rightly there is a form for the pathologist taking your blood to sign to state he/she has sighted your passport and you are who u are and they have to wright or stamp the pathology compnay...i have tried to find this sheet for you but with all the damm paperwork i have i couldnt find it...i also remember posting about this last year so if ya want this info will do a search for you...

i had the blood tests done around a week or so after i sent my readiness into the embassey...

sorry for the long post but if ya got any other questions just fire away mate thats what were here for..

told ya were are supportive in here..lol.....as much documentation and info you give them is better i reckon...but make a complete copy of the petition for yourself so you know what you sent in ..also the australian doesnt need to show their financial documentation only the us citz....Loke. in saying that if you think it will help with your partners poverty line to meet go for it ...good to see you again...

Hey everybody, just wanted to let everyone know that my wife has landed safely at LAX and is already on her plane to Florida...

We decided that it's just best for us to be together through this whole process. It's been rough on us, and we just needed to be together. We'll just hope Sydney works this whole thing out soon.

BTW... the POE Officer asked my wife why she was visiting and she told them straight out... "to visit my husband."

I have been wondering about the name change issue as well. I was going to hypenate my name with Jake's but I am not sure about this for the paperwork. Don't want to give immigration any additional reasons to stuff up.

Well I am still stuck here in Aussieland until I sell my car. Trying to save as much money as I can before I go. It's starting to get really frustrated knowing I have the Visa but can't quit my job until the car is sold which means we don't have a firm date for me arriving in the USA...grrrr. I know I shouldn't complain there are lots of people worse off it's just when you have been away from your SO for so long you are just hanging out to be together again. Work have been great about it, they have said they will keep me as long as I need.

Hope you are all hanging in there! Mmmmm, we haven't heard from Paul in a few days guess he's preoccupied frollicking in Adelaide with his wifey! tongue.gif

INTERVIEW... INTERVIEW... INTERVIEW... YESSSS!

Hi everyone in here!
I can't believe it! I've just updated our timeline and signature! Talked to Aaron on Skype at 5pm today (syd time). He got the letter!!!

Now, last night I was gonna log in and whinge about "stupid" consulate... well, they haven't been too smart really smile.gif but tonight I don't really care! They are forgiven!!! LOL

But, hey... can I still tell you the story???
First, they sent packet3 to Aaron. He had to Fedex it to me. I returned DS230 and that other page next day and what do they do???

Friday I got a letter saying: on DS230 you indicate living in two other countries. You need to obtain police check from those countries and let us know when you are ready for the interview by signing and returning the... whatever the number form it is... DSL 1076 or something like that! And I'm like... WHAT THE...??? (Yes, I love Rove Live). Of course I sent them copies of both forms with: I've already told you I was ready for the interview and I have all docs ready!

The best part though is: the interview letter Aaron got today is dated SAME (Feb 7th) as the one I got last Friday!!! Oh, who cares now?! I am so happy!!! And... curious about the interview!!!!
