Full Version: Claiming US citizenship for a child born abroad

Hi, does anyone one know anything about this process.

As I mentioned on the k-3 forum, I am expecting our first child and fear that the due date will come before I receive my k-3. Does anyone know how long this process takes? I know that the US citizen (my huband) is supose to report the birth to a US embassy right away but how long does it take. I'm sure that I would require some sort of documentation for my our baby when I enter the US to reside.

Hi & congrats. My wife in Philippines is expecting and we have been advised that if K3 does not process in time I am to take birth certificate and photo to US Embassy to get passport for baby, since the father is US Citizen the baby will get US Passport. As far as timelines, the US Consulate in Cebu told me and my wife it would take a few days to process for travel.

Both my children were born in the UK, I am a USC. We took each baby and birth certificate and my passport as proof of my citizenship to the US Consulate in Edinburgh and registered the child as a US citizen. We applied for the babies' passport as well. You are going to need the US passport so that the child can enter the USA as a citizen. Check out the US consulate's website for specifics. The passport photo has to be a very specific size and background.

I am in the same position, but I am freaking out.

Why? Because it is my understanding that they require an official Philippines birth certificate printed on security paper. These are generated by the NSO, and I have heard it takes 6 months to 2 years to get them.

Anyone out there with actual experiance on this?

Yes it is true that birth certificate in PI must be isued by NSO. if your child is registered in the province like visayas and mindanao it would take months to a year to be able to obtain NSO copy but if you did this in Luzon then it would just take 2 weeks to a month to get certified NSO copies. You can also ask the local civil registrar for rush process they will going to give you the copies in a sealed envelop and have you send it by fedex to NSO then you have to wait two weeks from the time you send the paper before you can obtain your certified BC from them. (based on my experienced) Good luck!

Claims to U.S. Citizenship

The ACS office can provide information and assistance to someone who believes he/she (or his/her children) has a claim to U.S. citizenship, including registration of children born in the Montréal area to U.S. citizen parents and who have a claim to citizenship at birth. We recommend that any claim to citizenship is documented as soon as practical after birth or after someone is first made aware of a possible claim.

In order to register the birth abroad of child under the age of 18, the U.S. citizen parent must appear in person at the Consulate with the following information in order to complete a Report of Birth Abroad application, which requires payment of a US$40 fee:


Proof of U.S. citizenship for one or both parents - at the time of the applicant's birth

An original civil birth certificate of the child showing both parents' names

Identification for the child (preferably with a photograph)

An original civil marriage certificate for the parents, along with original evidence of the dissolution of any prior marriages for both parents

Affidavit of physical presence and parentage if the child was born to an unwed U.S. citizen father

I'm expecting our 2nd CHILD!!! Just found out!!

LADIES ON K-3's!!!!!! YOU ARE ELIGIBLE FOR A MEDICAL EXPIDITE ACCORDING TO MY IMMIGRATION LAWYER.

My paperwork is going in and I should find out how fast my K-3 speeds up. I've been approved and my paperwork has been sent to Vancouver consulate.

As for our first daughter... claiming US citizenship is very easy if you were married before the child was born. It took 4 weeks to get our passport and certificate of US citizen born abroad. We even had some paperwork issues because my husband wasn't there. To make it fast and easy make sure you have all the items they need and both of you there would help but it's not essential.
