Full Version: K1/K2 visa in passport, but son decided to remain in switzerland

he got the K2 now in his passport, but doesnt want to use it anymore. but, of course, he wants to come for our wedding end of the year. what will happen on the immigration? will he have any problems when he tells them, he comes only for the wedding of his mom and wants to go back after? or do i have to cancel the visa before in his passport? thanks alot! smile.gif

If he has a visa, he must use that visa. If he wants to come and visit, then he'll need to get the K-2 visa cancelled very likely get a B visa issued before he can visit you..

I would recommend he bring the sealed envelope that he received with the K-2...without it he might have a problem. If he doesn't have it any longer, he will need to explain he is entering on the VWP instead but *should* still be able to enter the US without incident.

If he has the sealed envelope, he should be able to still enter on the K-2 visa, even if he just plans to visit. He shouldn't really even have to explain his circumstances at the POE (if he has the sealed envelope, etc), he has the visa and should be allowed to use it. If he decides for some reason to remain, he would be allowed to do so. That's what the K-2 visa is for! Whether he goes back or not doesn't really matter (except of course if he decides to come back later..he won't be able to re-use it). If he wants to return to the US later, another type of visa can be applied for at that time.

David's daughter received a K-2 and decided to remain (the morning they were leaving! huh.gif ) in England and came to the US for a visit later. She had no problems entering on the VWP, but the K-2 had expired.
