Full Version: I-765 Work Permit Application After I-485

Should I wait until after we get a NOA1 (from the Adjustment of Status submission) from our recently submitted I-485 before sending in the work permit authorization? Or is it ok to send it in now, even though we have not received the NOA1 for this. I'd like to get going on the work authorization application so Jum can get her work permit as soon as possible.

Why didn"t you file both applications at the same time?

You'll want to have the Receipt Notice for the I-485 to go with the I-765.

Given that Jum wants EA as quickly as possible, why didn't she include the I-765 with her I-485?

why is it so critical to wait for the receipt to apply for the EAD?

I don't think it is to be honest. As long as you have an alien number, the EAD should be linked to that. There's nowhere on the EAD form where you put the tracking number for your AOS after all. I guess including the AOS reciept does prove that you have filed for AOS, but they should know that anyway.

We didn't think that she would need it given our situation as she is not working. She has a driver's learner permit until the end of 2008 but the NC DMV will not give her a full license until they see some type of immigration related paperwork with a date beyond her original fiancee visa (that is expired now). It is hoped that by applying for the EAD it will arrive before the green card and be suitable for the requirements for the NC driver's license. We were trying to save a few dollars too. smile.gif

On the instructions to the I-765 form it states that if not filing at the same time as AOS then you have to show proof that your AOS has been filed or you will not be eligible for an EAD. This is because you are filing an EAD based off of adjustment of status and without having proof that you sent the application they can't say that you fall under the ©(9) category. That is why it is so important to have your NOA1. So I would wait for it if I were to save yourself any future complications. biggrin.gif Good Luck!!
