*********If you stayed over 180 days you will probably be denied a visa. However that doesn't mean you will get your petition denied.

At your interview you will be told you are ineligable for a visa and will have to file a waiver. Recommend you start reading up on that process and get your paperwork in order for that as you can turn your waiver in at the interview (at most embassies).***************

I read this on someone elses post on a different topic that wasn't so pleasent so I thought I would move it over here to ask my question wink.gif My situation is a little different but my understanding is that our visa will be denied and we will also have to file the waiver. My fiance came to the U.S. illegally and worked for 10 months. At this time he went back to Mexico and we filed for the K-1 visa a few months later. If it is possible to start getting the waiver ready where would I find infromation on that.

Thanks

You should most definitely get the waiver ready now since you will need a lot of evidence and documentation and that takes time to prepare. Here is where you find everything you need:

Start at the top and read through the stickies and examples.

Tomorrow, August 9 at 11:00 Central Time the Director of the Ciudad Juarez consulate will be attending an immigration chat regarding waivers and visa processing in Ciudad Juarez so your timing is great:

If you can't make it, I'm sure they'll post the recap.

Good luck
