Hi
I'm in the process of applying for a green card for the US and plan to join my partner, with my 2 year old boy, who is there on a H1B studying for the next 4 years. We plan to marry at some point but not in the near future. It is so so hard being 3500+ miles away.

just looking for advice and also making sure I don't miss anything in the process that will delay me and my son anymore time than is necessary.

You'll need to let us know what visa you have applied for in order for us to help.

If your visa is not a K1, K3, or CR1/IRI, you probably won't find good answers here. This is a marriage based visa forum.

On what basis are you applying for a Green Card, you do not mention any?

Just going from what you have posted the only Visa applicable would be a B. But that would take a couple of weeks to get.

What are you frustrated about?

What basis? There can only be an employment-related basis. I'd sense the frustration is that without marriage, there are few options available for immigration. The partner is on an H1-B, which suggests that he/she is not a USC or an LPR at this time. H1B has visa options but only for a spouse. Do you have a specialised talent?

My guess is Diversity Lottery.

Hopefully MrsB knows that her non-USC partner could get in on her application and everyone could become PR at the same time, if they time their events correctly.

Good guess.

But also need to be lucky, they would have heard by now for last year, so whats the problem?

But they would need to be married for the partner to get in on the act.

That's why I mention timing events. Don't know where she's at in (what) process and I'm not positive off the top of my head about when they have to have done the deed.

I guess we'll see what she has to say! smile.gif
