So I posted this at CR-1 to get answers, but got a few on the phone.

WEIRD I wrote a certified letter back in March to cancel my husband's I-130. Now I totally get why he got so much grief when he came down to help me move my stuff to canada (or the outskirts), it's because they never cancelled it.

So they approved our I-130 and mailed me the NOA in Calif. Which has a mail forward (and postal wouldn't forward since it was gov't) and they resent it to London, On.

So we're still in the process! Freaky because I just posted how we wanted to find out about DCF'ing or how to get back to US next year.

NVC changed my mailing address, but we are already assigned a MTL #

The NVC is re-sending the Fee Bill to me here. There is so much to think about my head is spinning. My stuff is in storage in the US. I don't want to pay to have it brought here if we are ____ months away from being able to go back.

What do I do next? Do I need to contact Montreal?

Whoa, what an unusual story. Certified mail is not signed for, so it may have arrived but then got lost! Would the "life changes" in your signature prevent you from going back to the States? Are you a Landed Immigrant in Canada now? You may have the doors open to you in both countries now. If you're in London, ON, better get a Brick Premium Lager and ask yourself: where do I really want to live?

HA!! Jersey girl I want to go home!! (This will be round 3 immigration knockouts), but the "life changes" was that hubby got this amazing job in London, and while we were driving up from california bad things happened, fired his partner and played a bunch of tricks. We've been kinda miserable ever since, as the reason I came this way was that he had found this great position. There aren't many boutique/gourmet style restaurants around here... so we were already going to look into DCF

Funny that I was calling toronto today to ask about DCF and BEHOLD this approval shows up. Now I just have to remove my Canada Immigration hat, and put my US Immi cap back on. I'm all confused! I (purposely) forgot the process. I am doing the landing in a few weeks, but leaving my *goods* in the states (I think!).

I might need to make a trek to get winter clothes as I see Montreal is moving very slow....

Going to use the bar code generator to send the AOS fee bill in tomorrow, and the Agent selection (a friend is going to accept the mail for us in U.S.)

How I tried to cancel it and it wouldn't die!! LOL

a new movie, The App That wouldn't Die from Another Country.

I was a bit spun out tonight so we went to a movie. My head is spinning from one immig to another. Yikes!! Hope tomorrow I can figure it all out and proceed correctly.

Sounds like you've made the decision to follow the I-130 and come home, even after getting landed status in Canada. The fly in the ointment would be if they suddenly find your cancellation letter and stop the process without telling you. Not sure how to avoid this. Perhaps paying the bill will be enough.

What happened to the I-129f? Any chance they received your letter and cancelled that? Did you get an NOA1?

I was under the impression the USC needs a US address when petitioning, and then submitting the affidvait of support. How can this happen if you're living in Ontario? Do you have relatives who'd let you use their address? Or would there be any merit in moving back to the States and getting a job? Detroit is close to London...

No wonder your head is spinning. Not sure if an immigration lawyer could help. Hope you can sort out the question of residency, since it will also have an impact on taxes. Hopefully, you can avoid becoming a Canadian resident and having to file in both countries.

Don't worry about winter clothes. Whatever you had in California will be a joke. If you're in Ontario this winter, buy stuff there.

If all this turns out well, you'll each be eligiblle to live and work in both countries.

Well I am glad you wrote this, I pulled up the withdrawal letters I sent.
To CSC, I sent a withdrawal of this app #, and it's already out of their hands, they're the ones who approved and forwarded and we already have a case #
To Montreal, it looks like I cancelled the MTL for the I-129 (diff # on letter)
To NVC I referenced the I-129 as well.
So due to my letter writing I'd say that I cancelled the I-129 everywhere but tried to do the I-130 at CSC (since it was still there) and they ignored the letter.

When I called NVC yesterday I said I was visiting my husband with my mail forwarding, and that is why I didn't get the letter (us mail won't forward something that *official*, gov't or credit cards either). He said OH ok, let's just change your address to the canada address.
I know you can also apply from Canada if you have PR, which I'll have in a few weeks. We're also appointing an agent in California to accept the mail.

HA laughing.gif I actually do have winter clothes, as I visited my husband for a year in Ottawa tee hee...

So now I just gotta find out if an "Agent" can be a family member?

Curiouser and curiouser. You applied for I-130 in January, then wrote to CSC in April asking to cancel. But something screwy happened and they approved it anyway? Do you think the petition was forwarded to NVC before they got to your letter (if they ever acted on it at all)?

You also wrote to Montreal to cancel I-129f. Did you have an interview? Otherwise, why write to Montreal? The I-129f goes from Chicago to Missouri to NVC to Montreal.

You also wrote to NVC, regarding the I-129f, making it doubly extinct. No more communications on the I-129f after the letters, right?

It could be you got a fairly speedy approval by the most bizarre means ever. Damn, girl, I'd say somebody's trying to tell you something! Meanwhile, you went to Ontario and got fairly quick Landed Status? Maybe you're meant to be a dual...

If you lived in Ottawa, you already know it'll be sweater weather in a month. Ever have beaver tails?

my guess, (and ONLY a guess), is that Service Centers might not allow a cancel of something via a letter. When I was trying to figure out how to cancel this stuff, nobody here at VJ had a clear cut plan, they just said, send a letter and keep copies, certified mail. So I did.

Now I'm thinking that in order to cancel an I130, you have to just not respond or pay the fees at NVC (as it states that on a form, failure to pay will cancel the process) ? maybe?

Right, just wrote asking them to cancel the I129 because it was the only thing I had an NOA on.

Is January to July speedy for I130? Hmmm!! Here I thought they took a long time. LOL

I actually had my first beavertail the night after we got married (married in Ottawa!) I even took a picture of it. laughing.gif

Well, dingdong, tongue.gif you're probably right. A letter to the Black Hole of California probably wasn't the way to cancel but what do I know. Now you have your first wish, which was to live together in the States. You also got a bonus, because Landed status gives you all the rights and privileges of a citizen (except to vote). At some point, you'll both be able to live and work in either country. How good is that?! Beavertails and brewskis all around!

hee hee!! How true. I wonder if they suddenly "find it" can they do anything to retract once we pay the fee? I hope not!! holy carp! that would be quite shocking
