Full Version: Do i still file a I129 F if the I130 is approved

I filed a I130 and may have waited to long to file a I 129 F. I mailed my I130 in March of 2006 and could not afford to send the I129F until July. I mailed the I129F petition and received notice it was received but then i received a notice that my I130 was approved and the paper word was forwarded on to the NVC.

I am concerned that i sent in the I129 F to late. ??? Does anyone know what will happen now that i have been approved for the I130 and just started the process of the I129F??

With all of the delays I would suspect that the K-3 won't be approved in quite some time. On the other hand if you have already paid the fee why not just let it ride and see what happens? You never know.

I was going to do what you did, but I've decided just to let my I-130 ride...and NOT file the I129....I would cancel the I129, and continue with the I130.

As you have already paid for and filed the I-129F for the K-3, just let it ride. We only filed the I-130 as it was approved quickly and too late for the I-129F to really be of any benefit.

sad.gif How would i cancel the i129f? Do you know? Does anyone know if i leave it as is, will it delay the I130.

I guess since the I130 is already approved i thought by the submitting of the I129F would delay the I130 process by redirecting the processing of the I130 process? I do not totally understand the role of the I129F since we were married in Senegal in December of 2005. We have been separated since then and i am trying not to delay anything if possible.

I received the approval right after i received the notice that the I129f application and fee were received.

So you think i should just continue with the I129F?

Yes, I think you should continue. smile.gif I'm not aware of any reason not to. Let it be a race 'til the finish. It sounds like your I-130 will be approved first, and it's more desirable to get the CR-1, but you never know.
