Hi,

I arrived 2 weeks ago to LA and the officers at the POE LAX were quiet nice, they didnt interview me anymore and just looked at the papers in the brown envelope and gave me a stamp in my passport. They didnt give me the EAD, I asked about it but they said that they dont give those. I was wondering if somebody knows if I can apply for the work authorization here in LA. Please let me know if that is possible.

no you dont get that once here you have to apply for that smile.gif

I think you can only get it through JFK now.

You don't get an EAD at the POE.... check out this thread for steps to apply for one. You can do this after you are married, at the same time you apply for the AOS.

Sorry should have been more clear... I assumed the Op was referring to the permanent EAD

Per the link:

As a K-1 Visa Holder you may receive a temporary EAD at the Point of Entry (POE). This has however become very uncommon and the only known POE that (and not always) issues these is JFK International Airport. if they do issue you a temporary EAD it will expire on the date that your K-1 expires (90 days from entry on your K-1).

I assumed they were talking about temp EAD you get at the airport... JFK is the only one that gives them now.

Not necessarily. There have been reports by other VJ members of receiving the temp stamp at other airports, although it is EXTREMELY rare.

There's no such thing asa "permanent EAD". They all expire.

When Val arrived back in May06 Miami. I asked and the officer said he knew nothing about a temp work authorization. I believe having your unexpired I-94 and having a SS number will authorize you to work during your 90 day fiance visa (only) - but I am not completely sure about this.

The mistake that we made (kind-off) was to get married first and then apply for Vals SS number which they would not issue in her new name since her maiden name was on the I-94. I call SS and they said we could apply under her maiden name and do a name change later but I did not want to risk any problems that could arise later + I did not really want to spend another 3 hours at the local SS office where they are nothing but complete a$$hole$.

Anyway we just filed for AOS and EAD about 3 weeks ago. Hope to hear something soon.

As a K1, you are work authorised - it's inherent to the status. However, you cannot prove it without either the EAD card for which you have to apply, or the temporary stamp given at JFK (and rarely other POEs). The proof is the problem, because you cannot fulfill the requirements of the I-9.
